Mike Lindell takes page from Trump playbook, to ask for special master if FBI does not return phone

MyPillow CEO Mike Lindell followed through on his promise to sue the government Tuesday and further threatened the request of a special master if conditions of the legal challenge weren’t met while promising, “I’m not going to ever let up.”

Just one week after being blocked in at a Hardee’s drive-thru by three FBI vehicles before having a warrant issued to seize his cell phone, Lindell filed suit in U.S. District Court for the District of Minnesota against Attorney General Merrick Garland, FBI Director Christopher Wray, the U.S. Attorney for the District of Minnesota and the U.S. government for violating his rights.

As previously reported, the seizure was said to be connected to an ongoing investigation into Mesa County, Colorado clerk Tina Peters facing felony charges for allegedly breaching election equipment security.

According to the complaint submitted Tuesday and signed by the businessman’s counsel including famed attorney Alan Dershowitz, the defendants “violated his rights protected by the First, Fourth, Fifth, and Sixth Amendments to the Constitution of the United States, (2) requiring the return of his cellular telephone and any data accessed from the cellular service provider, (3) enjoining Defendants from accessing any data collected on Plaintiff’s cellular telephone, and (4) prohibiting the release of any information by Defendants that they may have accessed after executing the Warrant.”

 

The Epoch Times first reported on the impending lawsuit and spoke with Kurt Olsen, one of Lindell’s attorneys, who clarified the legal team’s next move should any of the data on the “unlawfully obtained” seized phone be released.

“In any data that they access, we’re going to suppress the release of any information that they unlawfully obtained,” Olsen explained, “and in the alternative, we’re going to ask for a special master to be appointed to review and segregate the data on his phone from what was required under warrant.”

Lindell went on to explain to the Times that in addition to the violation of his rights, his business has suffered in various ways from the interaction. “That specific device was everything for me,” he laid forth reiterating the ongoing woes that he has experienced since the seizure, “There are so many apps now I don’t have the passwords to, also my hearing aids, everything run off that.”

According to the outlet, since the FBI executed its search warrant against Lindell, four businesses that partner with his online marketplace, MyStore, have cut ties, backing out of their agreements because of perceived wrongdoing on the part of the entrepreneur or “out of fear.”

Furthermore, Lindell was once again blacklisted by a bank that has decided it will no longer finance his products.

“It’s kind of like: ‘we don’t want to deal with Mike Lindell, he’s done something wrong.’ They don’t want to be guilty by association,” he expressed.

“What they have done is weaponize the FBI,” Lindell had said, when he first broke the news of the seizure and stated again to the Times, “We can’t have the FBI weaponized against our people in the United States.”

Discussing his ongoing crusade to uncover all the facts surrounding the 2020 presidential election and ensuring election integrity he concluded, “This has to happen. I’m not going to ever let up.”
