Senate Minority Leader Mitch McConnell said late last week that a national abortion ban was “possible” if Roe v Wade were to be overturned this year. This comes on the heels of a truly bombshell leak out of the Supreme Court indicating that Justice Samuel Alito drafted an opinion to reverse the 1971 Roe v. Wade ruling.
While the initial public reaction turned into a debate about the morality of abortion, justices inside the court were more immediately concerned with the leak which deeply threatens the integrity of the court.
Chief Justice Roberts provided a statement voicing his deep concern over the leak to the point that he has launched an internal investigation:
“Court employees have an exemplary and important tradition of respecting the confidentiality of the judicial process and upholding the trust of the Court. This was a singular and egregious breach of that trust that is an affront to the Court and the community of public servants who work here.”
“I have directed the Marshal of the Court to launch an investigation into the source of the leak.”
While the leak is a problem for the court, Democrats and Republicans are more concerned with jockeying for position in anticipation for one of the biggest supreme court battles since the original Roe V Wade ruling.
In an interview with USA Today, McConnell was pressed on what exactly a repeal of Roe v. Wade would mean and whether or not it would be possible for a total ban at the federal level.
“If the leaked opinion became the final opinion, legislative bodies — not only at the state level but at the federal level — certainly could legislate in that area,” the GOP leader said. “And if this were the final decision, that was the point that it should be resolved one way or another in the legislative process. So yeah, it’s possible.”
He does not give a definitive answer on a federal ban but he does acknowledge the outcome as a possibility, after being asked if such a ban would be “worthy of debate.”
Senate Majority Leader Chuck Schumer, D-N.Y., and Speaker Nancy Pelosi, D-Calif., took the opportunity to go on the offensive and mobilize their base ahead of a grim-looking midterm election period for Democrats. Pelosi released a lengthy statement on Twitter characterizing the possible overturn of Roe as an “abomination” and said that it could be “one of the worst and most damaging decisions in modern history.”

Schumer stated that he would force a vote to codify Roe v Wade as soon as possible but it would most likely be inconsequential as the Democrats would not have enough votes. He also stressed the importance of this issue within the context of the 2022 midterm elections:
“Mitch McConnell confirmed what voters have long known: Republicans will use every tool they can, from the courts to Congress, to make abortion illegal everywhere and strip away a woman’s right to make our own decisions. For voters, the stakes of protecting and expanding our Democratic Senate majority in 2022 have never been higher.”
This has been one of the first real opportunities for Democrats to mobilize their base ahead of an election cycle that is expected to be a sweeping victory by Republicans, even by conservative estimates.
