The latest in “Total LUNACY” found a judge ruling that the left’s favorite “Maryland Man” should be released from custody pending trial.
In the months since Salvadoran national Kilmar Abrego Garcia became the face of the globalists’ open borders agenda after his deportation to his home country, caterwauling, activism, and lawfare have been sufficient to bring the illegal alien back to the United States under the pretense of “due process.”
Sunday, an order from U.S. Magistrate Judge Barbara Holmes in a 51-page memo found that the man facing trial for alleged human smuggling and gun smuggling should not be detained pending trial.
“As required by the Bail Reform Act, the Court has reviewed the evidence presented at the June 13 hearing and considered the parties’ arguments and the Pretrial Services report. For the reasons detailed below, the government’s motion for detention is DENIED,” wrote the Obama-appointed Holmes.
“Specifically, the Court finds that no detention hearing is authorized under the Bail Reform Act in this case because the government failed to prove that this case involves: (1) a minor victim within the meaning of § 3142(f)(1)(E); (2) a ‘serious risk’ that Abrego will flee, as required by by § 3142(f)(2)(A); or, (3) a ‘serious risk’ that Abrego will obstruct justice or otherwise interfere with the integrity of this proceeding, as required by § 3142(f)(2)(B),” she argued before insisting, “the Court finds that there are conditions of release that can be imposed to reasonably assure the safety of others and the community and to reasonably assure Abrego’s appearance as required.”
Reacting to the ruling that was deemed “Lunacy. Total LUNACY,” by Florida’s Voice Assistant News Director Eric Daugherty, Department of Homeland Security Assistant Secretary for Public Affairs Tricia McLaughlin stated, “Kilmar Abrego Garcia is a dangerous criminal illegal alien. We have said it for months and it remains true to this day: he will never go free on American soil.”

Amid an appeal from the government, U.S. Immigration and Customs Enforcement maintained a detainer on Abrego Garcia pending his other case regarding deportation. Holmes made note of that in her introduction and said, “Either Abrego will remain in the custody of the Attorney General or her designee pending trial if detained under the Bail Reform Act or he will likely remain in U.S. Immigration and Customs Enforcement (‘ICE’) custody subject to anticipated removal proceedings that are outside the jurisdiction of this Court.”
“That suggests the Court’s determination of the detention issues is little more than an academic exercise,” she stated further before emphasizing the popular talking point of the left amid President Donald Trump’s mass deportation efforts. “That suggestion is understandable. But the foundation of the administration of our criminal law depends on the bedrock of due process. That due process demands that every person charged with a federal crime be afforded a presumption of innocence unless proven guilty beyond a reasonable doubt and that deprivation of an individual’s liberty prior to trial can occur only in carefully limited circumstances with all the procedural safeguards afforded by the Bail Reform Act.”
