Biden-Harris bureaucrats poised to enact a backdoor vape ban

Congressional Republicans and Hill staffers are raising alarms that, in the final weeks of holding onto power, the Biden administration is working to enact a “backdoor ban” on popular flavored vapes.

This is considered a payback to billionaire Michael Bloomberg who has long campaigned for outlawing the tobacco-alternative products.

“Every American who cares about personal freedom should be up in arms about this, and expect substantial oversight once the new Congress starts,” said a top Senate aide.

The “backdoor ban” would be executed through the U.S. International Trade Commission, a little-known but influential agency that deals with trade and patent disputes.

Last year, Juul, the vaping company, filed a patent dispute against NJOY, another vaping company, and sought a “ban on an importation of the sale of NJOY products” in the U.S. as part of the dispute.

This summer, an administrative law judge at the Commission took Juul’s side in the patent dispute and recommended a ban on NJOY products, including the popular “Ace” brand that is the only menthol-based vape approved by the FDA in the U.S.

If this ban is enacted, leading health and national security experts point out the serious consequences, as any loss of a U.S. approved vaping product would likely mean larger market share for unapproved Chinese vapes.

The presence of illegal vapes has long been a topic of concern for leading policymakers on a bipartisan basis.

“You’ve completely fallen down on the job,” Senator Dick Durbin told officials from the FDA for failing to stop the influx of Chinese vapes.

Senator John Cornyn criticized the Biden administration for failing to crack dow on the vapes, saying, “You can’t sell them in China but you can sell them in the United States?”

Hill sources said the Biden administration is seen as likely to go along with the U.S. Trade Commission by allowing the ban on NJOY products to move forward.

A Senate source said, “The Biden Administration couldn’t get their menthol ban done, so they think working with the trade commission to ban vapes is the next best thing. This is nothing more than a payback to Michael Bloomberg for his donations, and Republicans should fight back.”

Jeremy Hunt, a leading national security expert and Fox News contributor said, “the International Trade Commission (ITC)’s potential decision to block the only FDA-approved U.S. vaping device could have serious unintended consequences. Such a move could allow unlicensed and often dangerous Chinese vapes to increase their market share in the U.S., posing risks to families and children.”
