President Joe Biden has been outed by the Democratic governor of Kentucky who has released an email showing that he planned to nominate an anti-abortion Republican to a federal judgeship the day that SCOTUS overturned Roe v. Wade.
The White House is not commenting and it is unclear if Biden still intends to move forward with the nomination. Leftists are furious over the development and are venting all over social media about it.
The Louisville Courier-Journal was given the email to publish by Kentucky Democratic Gov. Andy Beshear. The communication shows that Biden intended to nominate Chad Meredith, an anti-abortion member of the conservative Federalist Society to a judgeship in the Eastern District of Kentucky. The media outlet reported last week on the pending nomination but they didn’t get the email from Beshear until Tuesday.
“White House aide Kathleen M. Marshall, a former lieutenant governor in Nevada who joined the White House in August as senior adviser to governors in the Office of Intergovernmental Affairs, sent the June 23 email that stated: ‘To be nominated tomorrow: … Stephen Chad Meredith: candidate for the United States District Court for the Eastern District of Kentucky,” the Louisville Courier-Journal reported.

The nomination did not move forward as planned due to Roe v. Wade being overturned by the Supreme Court which ruled there is no constitutional right to abortion and handed the power back to the states to decide the issue.
The nomination was part and parcel of a deal that was made between Biden and Senate Minority Leader Mitch McConnell (R-Ky.), Slate reported.
In exchange, McConnell would not stand in the way of Biden’s appointment of federal prosecutors in Kentucky.
Liberals immediately cried foul over the arrangement, contending that federal prosecutors could be dismissed by whoever succeeds Biden while Meredith would receive a lifetime appointment. Rep. John Yarmuth (D-Ky.) is one of the Democrats who strongly opposes Meredith’s nomination.
Mediaite reported on the “I’ll scratch your back if you scratch mine” process: “McConnell’s obstruction of appointees in Kentucky does not stem from any legal authority, but instead the customs of the Senate. Key to the process are ‘blue slips.’ As is custom, a senator may essentially veto a federal nomination when the nominee would serve in the senator’s jurisdiction. This practice has been terminated for appeals court nominees, but it remains in place at the district court level.”

National abortion rights groups decried the potential nomination on Tuesday, criticizing it in a joint statement that included Planned Parenthood Federation Of America, NARAL Pro-Choice America, National Women’s Law Center, National Council Of Jewish Women, All* Above All Action Fund, URGE, Catholics for Choice and Physicians for Reproductive Health, according to USA Today.
“We are in a national abortion crisis,” the groups stated. “We are in this moment because anti-abortion judges were intentionally nominated at every level to take away our fundamental right to abortion — and given his record, we know Chad Meredith would be no exception.”
“Chad Meredith should not be nominated to a lifetime judgeship. This is unacceptable at any time, but especially on the heels of six Supreme Court justices taking away a fundamental right from millions of people,” the pro-abortion groups declared.

Stephen Pitt, a general counsel to conservative former Kentucky Gov. Matt Bevin (R), wrote in a letter in 2018 that Meredith “would be a strong and dependable conservative asset to the federal judiciary for decades,” according to HuffPost.
He would “adhere to the textualist and originalist viewpoint followed by the late Justice Scalia and by other justices, such as Justice Thomas and Justice [Neil] Gorsuch,” Pitt wrote. “In sum, it is my opinion that the qualities I believe you think are most important in a federal judge are the same as I hold to. Based upon that belief, I can recommend Chad Meredith without reservation.”
