In a Tuesday video teasing big things to come, Rep. Liz Cheney sought to generate interest in the January 6 select committee’s show trial of Donald J. Trump by releasing a clip of a White House lawyer testifying that he advised a close adviser to the former president to lawyer up.
With the committee failing to break through to the massive audience that Democrats had anticipated when they scheduled the debut in primetime and hired a former ABC News exec to package their product for mass consumption, there is a desperate need to hook viewers for a sham proceeding likely to end with the referral of a criminal indictment of Trump to prevent him from running for the White House in 2024.
Cheney, who has spearheaded the hearings much to the delight of Speaker Nancy Pelosi, posted her clip of former White House lawyer Eric Herschmann in a recorded message to the committee’s social media accounts, seeking to manufacture the narrative that Trump knew that he had lost the election, a critical point that is the lynchpin of the trumped-up case against the ex-POTUS despite his ongoing insistence that he was cheated out of a second term.
“Yesterday, the select committee’s hearing showed all Americans that President Trump’s claims of a stolen 2020 election were to use former Attorney General Barr’s words “complete nonsense.” We heard this from Donald Trump’s own campaign experts, his own campaign lawyers, his own campaign manager, his attorney general and others Donald Trump appointed to leadership positions in the U.S. Department of Justice,” Cheney said in the video.

“President Trump’s advisors knew what he was saying was false, and they told him so, directly and repeatedly,” she continued, referring people to the J6 committee’s website and promoting Thursday’s next hearing which she said will examine Trump’s “relentless effort” to pressure then-Vice President Mike Pence to “refuse to count lawful electoral votes,” before going to Herschmann who recounted his January 7, 2021 conversation with lawyer John Eastman.
“It was the day after,” Herschmann said in the recorded message, “Eastman – I don’t remember why he called me, or he texted me or called me, wanted to talk with me and he said he couldn’t reach others.”
“And he started to ask me about, I think dealing with Georgia and preserving something potentially for appeal,” he continued, “and I said to him, are you out of your f**king mind? I said I only want to hear two words coming out of your mouth from now on: orderly transition.”
“I said I don’t want to hear any other f**king words coming out of your mouth, no matter what, other than orderly transition,” Herschmann said. “Repeat those words to me,”
“Eventually, he said orderly transition, I said ‘good John, now I’m going to give you the best free legal advice you’re ever getting in your life,'” he said. “‘Get a great f**king criminal defense lawyer, you’re going to need it,’ and then I hung up on him.”
Cheney’s effort to build suspense for the rescheduled committee hearing comes after she suffered the humiliation of having one of her sinister conspiracy theories debunked, the claim that a Republican lawmaker led a recon mission on the Capitol on January 5, 2021.
On Tuesday, Capitol Police Chief J. Thomas Manger shot down the false claim by Cheney and committee chairman Bennie Thompson that Rep. Barry Loudermilk of Georgia aided J6 rioters on a tour for the purpose of casing the building.
“There is no evidence that Representative Loudermilk entered the U.S. Capitol with this group on January 5, 2021,” Manger wrote. “We train our officers on being alert for people conducting surveillance or reconnaissance, and we do not consider any of the activities we observed as suspicious,” he added, in a blow to Cheney’s credibility.
Whether Herschmann’s testimony will move the needle on viewership remains to be seen; the next hearing will take place on Thursday.
