Parental rights groups express ‘deep concerns’ over upcoming Biden admin. revisions

A collection of parental rights groups are expressing serious concerns about the Biden administration’s upcoming changes to Title IX, the civil rights law that prohibits sex discrimination in educational institutions which receive money from the federal government.

In March 2021, President Joe Biden signed an executive order to review the law, leading to fears that it will be overhauled, particularly in terms of the definition of gender and gender identity, changes that will have a dramatic effect that some fear will adversely affect the safety of students. The updates to Title IX are also likely to erase reforms that were put into place during the Trump administration which required due process and transparency for those accused of sexual assault.

The coalition groups who say that they represent nearly 400,000 parents sent a letter to Secretary of Education Miguel Cardona last month imploring him to consider their “deep concerns ” over coming revisions.

“On behalf of our 27 organizations’ 393,823 members, the undersigned groups write to you to express our deep concerns over the U.S. Department of Education’s forthcoming rewrite of Title IX sex discrimination rules,” the letter reads. “We oppose any moves to rescind the much-needed Title IX reforms which were enacted in 2020, as they strengthened and reinforced basic due process and civil rights protections. Furthermore, we vehemently disagree with the Department’s purported incorporation of “gender identity” into Title IX regulations.

“We represent parents, grandparents, and concerned citizens across the country who are worried that the forthcoming rule changes are a politicized effort to placate activists,” the groups wrote. “In fact, the sweeping changes to Title IX that you are reportedly set to announce would erode the very rights that protect all students – regardless of sex – and ensure a safe and equitable learning environment.”

Representatives for the groups behind the letter discussed their concerns with Fox News Digital including Tiffany Justice who is the co-founder of Moms for Liberty.

“We see that this idea of identifying students in general by identity than by biological is concerning to us,” she said. “We’re seeing sexual harassment claims, or harassment claims as language is violence, being used by students who accidentally misgender a child in the classroom. Sometimes genders are fluid. Instances where a child was being told to kill themselves and being bullied by a group of students who were literally changing their gender every day and then the school was looking at harassment violations or harassment claims against that child, which was not the case. These are 11-year-olds.”

“We don’t see any reasons why it needs to be changed,” Justice continued. “We think it really is the erasure of women in general. And as mothers, we are women, adult human females, who are not birthing people.”

Army of Parents president and co-founder Elicia Brand told Fox News Digital that her group signed the letter to protect female students.

“Title IX under Obama, and now under Biden, is being twisted and used as a weapon against girls and women, that Title IX was actually written to protect us. And we will suffer the most, particularly our girls who are in sports,” she said.

“We don’t want this to be weaponized under Biden while his executive order doesn’t carry the full weight of the law as Trump’s did,” Brand continued. “It is still very dangerous because it gives the Department of Education the ability to bring lawsuits against schools and in that way they have to comply because they can’t lose the money. So the people that will be suffering will be girls and women.”

She also said that the 1972 Congress which passed the law likely had “no idea” that it could one day be expanded to include transgenders.

The letter to Secretary Cardona also raises the issue of sports locker rooms.

“The revisions to Title IX the Department is set to announce would discard the concept of male and female enshrined in Title IX itself, through expanding Title IX’s protections to include ‘gender identity.’ Who is now male and female? Anyone can be anything they want – an individual may simply ‘identify’ as one, or none, or one of an ever-expanding menu of ‘gender identities’ promoted by activists,” the letter reads.

“For schools, this means that female sports teams, bathrooms, and locker rooms would be open to anyone who ‘identifies’ as female, and vice versa. Under the Department’s new rules, separating athletic teams and intimate facilities based on biological sex would be illegal,” the letter continues. “If a high school boy declares that he ‘identifies’ as a girl, the school would be required to allow him to walk into the girls’ locker room while girls are changing, or enter the girls’ bathroom to use the facilities alongside his female peers. Any attempt to prevent this would be discriminatory conduct prohibited by Title IX.”

“With regard to sports, the Department’s new ‘gender identity’ rule would rob girls and women of equal athletic opportunities by requiring schools to allow biological boys and men to compete in women’s athletics,” the coalition wrote, urging Cardona to “reject the ideology behind this attempt to use the Department of Education to accomplish what has not been achieved at the ballot box or by Congress.”

Last year, Secretary Cardona commemorated Title IX’s 49th anniversary by declaring, “Today marks 49 years since the passage of Title IX, the strongest tool we have to protect every student’s right to equal access to educational opportunities free from sex discrimination,”

“I’m proud of the actions the Biden-Harris Administration has taken so far in ensuring that Title IX protects the civil rights of all students, including LGBTQ+ students, in our schools and on college campuses,” he added later. “As Secretary of Education, I am committed to ensuring Title IX works for all students and provides equal access to opportunities that will enrich students’ educational experiences and their futures.”
