Freedom-loving Americans celebrated on Monday after a Florida federal judge struck down President Joe Biden’s transportation mask mandate in another blow to the White House and its authoritarian response to the COVID pandemic, the second major court defeat this year.
In a stinging rebuke to the Biden administration’s overreach, U.S. District Judge Kathryn Kimball Mizelle ruled in Tampa that the mandate by the U.S. Centers for Disease Control and Prevention (CDC) that applied to airlines and other public transportation exceeded the agency’s authority, ruling in favor of the Health Freedom Defense Fund, a group that sued the regime over the order that has been set to expire several times.
In a 59-page ruling, Judge Mizelle, who was appointed by former President Donald J. Trump wrote, “Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the court declares unlawful and vacates the mask mandate.”
Her smackdown of the CDC comes after public health bureaucrats once again moved the goalposts by extending the controversial mandate last week. It is huge another setback for Biden whose employer vaccine mandate was shot down in flames by the Supreme Court in January.
Florida Governor Ron DeSantis whose leadership on COVID has been the gold standard hailed the ruling.
“Great to see a federal judge in Florida follow the law and reject the Biden transportation mask mandate. Both airline employees and passengers deserve to have this misery end,” the Sunshine State Republican tweeted.

Others reacted to the ruling.
“If you’re an anti-science loser who wants to wear a mask on an airplane for the rest of your life, you can do that. But the rest of us are long since ready for idiocy to end,” wrote Clay Travis of Outkick.com and the nationally syndicated Clay & Buck Show.

“Great news—a federal judge struck down Biden’s stupid transportation mask mandate, “wrote Republican Senator Tom Cotton. “This is a win for common sense and a crushing loss for the Democrats’ obsession with forcing Americans to wear masks forever.”

GOP Rep. Lee Zeldin of New York wrote, “Great news! The Biden Admin’s unscientific travel mask mandate has been STRUCK DOWN by a federal judge! This is the correct & long overdue decision. Americans are ready for a return to normalcy & it’s time for @JoeBiden & control freak bureaucrats to stop standing in their way.”

More reactions to the good news.
.@CDCgov NEVER had the legal authority to impose or authorize a mask mandate on airplanes and other modes of transportation.
Glad to see the illogical, illegal, unscientific mask mandate come to an end!

The meltdown by beltway “journalists” over Biden’s arbitrary, non-scientific and ridiculous mask mandate is quite something. They’re fine with removing the mask at fancy dinners of course, but the rest of America (which moved on from COVID a long time ago) must suffer on planes.

SO glad the judge pumped the breaks on travel mask mandate. And for the billionth time if you think the mask works you don’t need the guy in the seat next to you to wear one. This is like making someone wear a jacket so YOU don’t get frostbite. Stop it already.

IMO the Biden administration is going to appeal the ruling against its federal transportation mask mandate. They’ll soon get a “stay,” so the mandate will continue to be in effect. Then it’ll expire May 3, before the court of appeals decides. But this is going to hurt Democrats…

The democrats were too cowardly to end the moronic mask mandate on planes, so a federal judge (appointed by trump) stepped up
But don’t ever forget what a bunch of wimps Fauci and the rest were on this

5 days ago, the Biden Administration extended the federal mask mandate for public transportation.
Today, a Trump-appointed judge overturned the mandate.

Biden is 0 for 2 with his illegal mandates. His airplane mask mandate has also been ruled illegal.

I’m not sure if I’m happier about not having to wear a mask on the plane or happier about flight attendants not being able to run around screaming like they’re dictators of the sky.

Not everyone was happy, especially the White House which could fight back with Justice Department litigation, a possibility left open by outgoing White House press secretary Jen Psaki.
Press Sec. says it's 'obviously disappointing' a Florida federal judge voided US mask mandate for planes & says the Dept of Homeland Security is reviewing the decision
"This is obviously a disappointing decision. The CDC continues recommending wearing a mask in public transit. " pic.twitter.com/64MMprcHRo
— Breaking911 (@Breaking911) April 18, 2022
“The CDC recommended continuing the order for additional time – two weeks – to be able to assess the latest science in keeping with its responsibility to protect the American people,” Psaki said.
She added, “So this is obviously a disappointing decision, the CDC continues recommending wearing a mask in public transit, as you know this just came out this afternoon so right now the Department of Homeland Security who would be implementing and the CDC are reviewing the decision and of course, the Department of Justice would make any determinations about litigation.”
Leftist COVID cultists also melted down as their false perception of moral superiority continues to slip through their grasp.
Today a federal judge called it overreach for US health officials to require masks on airplanes & other public transit, and no matter how you feel about masks, you should be really, really concerned that the Courts are effectively taking away power from the federal government.

Try explaining to your friends in other liberal democracies that a single unelected, life-tenured, 35-year-old judge just abolished the air travel mask mandate for the entire country.
No peer nation would tolerate such a power-drunk juristocracy. Our system is badly broken.
— Mark Joseph Stern (@mjs_DC) April 18, 2022
Regardless of whether you agree or disagree with the end of the mask mandate on public transport, it should trouble every American that public policy is being dictated by an unqualified district judge who was confirmed by a lame duck Congress.

We as a nation are fucking hellbound to destroy ourselves. We are addicted to self-destruction — all at the behest of the corporations and politicians who will gladly use our bodies as firewood. https://t.co/MxPlXtLOYa

This isn’t something “we” are doing. We are under attack from within. This is part of that attack.

Deeply disappointed at the decision by @united to remove the mask mandate on planes effective immediately. I know that it's fashionable these days not to care about people who just happen to be at high risk, but this deeply saddens me.

Another possibility is that the administration may not choose the mask mandate as the hill to die on, while a battle over transportation masking would greatly please the dead-enders, it could sway even more voters to toss the party out of power in the midterms.
