Freedom-loving Americans celebrated on Monday after a Florida federal judge struck down President Joe Biden’s transportation mask mandate in another blow to the White House and its authoritarian response to the COVID pandemic, the second major court defeat this year.
In a stinging rebuke to the Biden administration’s overreach, U.S. District Judge Kathryn Kimball Mizelle ruled in Tampa that the mandate by the U.S. Centers for Disease Control and Prevention (CDC) that applied to airlines and other public transportation exceeded the agency’s authority, ruling in favor of the Health Freedom Defense Fund, a group that sued the regime over the order that has been set to expire several times.
In a 59-page ruling, Judge Mizelle, who was appointed by former President Donald J. Trump wrote, “Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the court declares unlawful and vacates the mask mandate.”
Her smackdown of the CDC comes after public health bureaucrats once again moved the goalposts by extending the controversial mandate last week. It is huge another setback for Biden whose employer vaccine mandate was shot down in flames by the Supreme Court in January.
Florida Governor Ron DeSantis whose leadership on COVID has been the gold standard hailed the ruling.
“Great to see a federal judge in Florida follow the law and reject the Biden transportation mask mandate. Both airline employees and passengers deserve to have this misery end,” the Sunshine State Republican tweeted.

Others reacted to the ruling.
“If you’re an anti-science loser who wants to wear a mask on an airplane for the rest of your life, you can do that. But the rest of us are long since ready for idiocy to end,” wrote Clay Travis of Outkick.com and the nationally syndicated Clay & Buck Show.

IMO the Biden administration is going to appeal the ruling against its federal transportation mask mandate. They’ll soon get a “stay,” so the mandate will continue to be in effect. Then it’ll expire May 3, before the court of appeals decides. But this is going to hurt Democrats…

“The CDC recommended continuing the order for additional time – two weeks – to be able to assess the latest science in keeping with its responsibility to protect the American people,” Psaki said.
She added, “So this is obviously a disappointing decision, the CDC continues recommending wearing a mask in public transit, as you know this just came out this afternoon so right now the Department of Homeland Security who would be implementing and the CDC are reviewing the decision and of course, the Department of Justice would make any determinations about litigation.”

Another possibility is that the administration may not choose the mask mandate as the hill to die on, while a battle over transportation masking would greatly please the dead-enders, it could sway even more voters to toss the party out of power in the midterms.
