Rep. Darrell Issa (R-CA) suggested, even with evidence that would “lynch” Hillary Clinton, Special Counsel John Durham’s investigation has taken too long to effect her.
In a discussion with investigative journalist Sharyl Attikisson on her program “Full Measure,” Issa lamented the ongoing nature of of the Durham report.
“‘Justice delayed is justice denied’ is not some sort of a trite statement,” Issa said. “It’s very true.”
“Any thing that comes out of the Durham report,” Issa said with a scoff, “it could lynch Hillary Clinton and it wouldn’t change a thing. The fact is, time has passed.”
Attkisson had recounted before introducing Issa that Durham had been tasked in Spring 2019 by then-Attorney General William Barr to investigate possible criminal mischief on the part of the FBI for their probe into Donald Trump’s 2016 presidential campaign. Durham missed promised deadlines to release relevant findings prior to the November 2020 election.
Three indictments have come from the investigation. FBI attorney Kevin Clinesmith pled guilty to altering documents to obtain a wiretap for the FBI to surveil a member or the Trump campaign. Clinton attorney Michael Sussmann had also been indicted for providing the FBI with fraudulent connections between Trump and Russia which led to Durham’s February 11 filing.
“It is pretty irrelevant,” Issa went on with regards to getting justice for the major players behind, “except it’s a lesson to Congress that putting real-time limits and putting real meat in activities, including inspector general’s reports and so on, is more important than ever.”
“The time it takes to complete an investigation, or the time it takes for Congress to get to the truth,” Issa explained, “impacts whether or not you’re going to get the truth and compliance in a timely fashion.”
“If you can hold an administration accountable in real time,” Issa suggested, “they will cooperate. If they know they can run out the clock, as they often do, they won’t.”
Attkisson and Issa went on to discuss continued promises by the Department of Justice and FBI to “do better next time” as abuses and lapses are recorded with no accountability. Issa offered up removing authorizations granted by the PATRIOT Act as a means to straighten out the failings.
“No, your time is up,” Issa said was the stance to take on reauthorizations without civil or criminal penalties for misconduct or failure on the part of the DOJ and the FBI.
Clinton is perhaps as aware as Issa is that this investigation may have timed out. However, rather than ignoring it and letting it fade away, she spent a good deal of time remarking on it publicly. She referred to it as a “fake scandal” drummed up by Trump and Fox News in a Vanity Fair article in addition to other media appearances.
The prescience of Issa’s view has yet to play out as Durham continues his investigation and the case against Sussmann continues its journey through the courts with the next hearing set for March 31.
