The Texas law banning abortions past six weeks of pregnancy is back in effect again after a preliminary injunction earlier this week which had halted the controversial law.
The 5th U.S. Circuit Court of Appeals granted a “temporary, administrative stay of this week’s preliminary injunction” on the “fetal heartbeat” abortion ban on Friday night, reinstating the law after it was temporarily halted in a ruling by U.S. District Court Judge Robert Pitman.
Texas Attorney General Ken Paxton had quickly filed an appeal of the lower court’s decision which came on the heels of the law taking effect on Sept. 1.
Senate Bill 8 banned abortions once a fetal heartbeat could be detected, usually around six weeks into a pregnancy. The law also allowed citizens to sue abortion providers or those who aided a woman who sought to terminate a pregnancy after about six weeks.

“Great news tonight, The Fifth Circuit has granted an administrative stay on #SB8. I will fight federal overreach at every turn,” Paxton wrote on Twitter following the federal appeals court reinstating the law Friday.

The ruling gives the Department of Justice until Tuesday to respond.
