A federal judge handed the Biden administration a victory Tuesday in its ongoing efforts to send illegal immigrants by the thousands to all four corners of the nation and everywhere in between.
“U.S. District Judge Kathleen Cardone in El Paso granted the Justice Department’s request for a temporary restraining order against the ban, saying the department was likely to prevail on arguments that the Texas ban unconstitutionally interfered with the federal government’s operations and conflicted with U.S. immigration law,” the Wall Street Journal reported.
Somewhat fittingly, Cardone is a George W. Bush appointee, and the WSJ further reported that the judge said the executive order was causing irreparable harm to the federal government “and to individuals the United States is charged with protecting, jeopardizing the health and safety of non-citizens in federal custody, risking the safety of federal law enforcement personnel and their families, and exacerbating the spread of COVID-19.”
In furtherance of its open-border stance, the administration sued Texas Gov. Greg Abbott last week over an executive order that banned the transportation of migrants within the state by anyone other than law enforcement. The Republican governor said his state was being exposed to “a public health disaster” due to the risk of many of the migrants having COVID-19 in the face of a surge of the highly contagious delta variant.
Court documents show that an average of over 1,100 migrants are transferred every day from Customs and Border Protection custody at the southwest border “almost exclusively by contractors,” the Texas Tribune reported.
Migrants are being bussed and flown to all points throughout the country, with many not even being given court dates, not that most ever show up for them. Yet, the safety of U.S. citizens potentially being exposed to COVID-19 does not seem to factor in.
Just as the liberal media looks the other way to 1 million+ migrants crossing illegally into the United States this year already, they also ignore Border Patrol union leaders saying that even when testing positive for COVID-19, migrants are being released into the continental U.S.
(In the ultimate irony, the administration is not allowing migrants who test positive for COVID-19 to board return flights when being deported.)
And while the same media are quick to note that Florida has become the epicenter of the latest surge, there’s zero intellectual curiosity about the possible impact the open border could be having.
Last week, Florida Gov. Ron DeSantis visited the southern border with Mexico along with Gov. Abbott and said afterward that he was told that 70% of illegal immigrants apprehended in that sector said Florida was their ultimate destination.
“They’ve made over 2,000 apprehensions, over 100 felony arrests, and they say that almost 70% of everybody that they have interdicted said their ultimate destination was the state of Florida,” DeSantis said at a press conference.
Abbott responded to the judge’s ruling during an appearance Tuesday night on Fox News and shared the clip online, saying the Biden White House is “blocking us from protecting Texans from COVID positive migrants.”

“We’ll have a full hearing in the coming weeks where we will be able to put on the evidence about how the Biden administration is exposing Texans to thousands of migrants who are bringing COVID-19 into the United States of America,” Abbott said.
Texas Attorney General Ken Paxton called Abbott’s executive order “much-needed” and “perfectly legal” last week, in response to the DOJ lawsuit, according to the Texas Tribune.
