The Biden Justice Department has officially dropped an investigation into discriminatory practices in the admissions process at Yale. This was done despite the Trump Justice Department finding that Yale had discriminated against applicants based on race in October of 2020.
The announcement was made on Wednesday in a two-sentence filing made with a federal district court in Connecticut. It stated that the case was being dropped over alleged racial discrimination. A judge will still have to sign off on that in order to dismiss the two-year probe.
Under former President Trump, it was determined that Yale had discriminated against white and Asian applicants in order to admit more “racially-favored applicants.” The university was threatened with a lawsuit if it did not modify its admission practices.
“For at least 50 years, Defendant Yale University has intentionally subjected applicants to Yale College to discrimination on the grounds of race and national origin,” the Justice Department concluded in their findings in 2020. “For the last few decades, Yale’s oversized standardless, intentional use of race has subjected domestic, non-transfer applicants to Yale College to discrimination on the ground of race.”
According to The Daily Wire, “black students were five to eight times more likely and Hispanics were two to four times more likely to be admitted to Yale than their white and Asian counterparts with similar academic achievements. In 2017 and 2018, 6.4 percent of white and Asian applicants were admitted to the incoming freshman class, while 8.3 percent of Hispanic and 9.5 percent of black applicants were admitted.” That’s quite a disparity.
Yale claims that its selection criteria looks at “the whole person when selecting whom to admit among the many thousands of highly qualified applicants.” They also claim that they have complied with legal precedent set by the Supreme Court.
While Biden was campaigning for the presidency in September, he tweeted: “This is our moment to tackle systemic racism head-on and build a nation true to our founding ideals. A nation where all men and women are not only created equal — but treated equally.” Ironically, Biden just signed an executive order to combat anti-Asian discrimination. It’s confusing, to say the least.
Yale is thrilled with the decision and with their alumni President Biden. Originally when the suit was filed, Yale deemed it to be hasty and meritless.
“Yale is gratified that the US Justice Department has dropped its lawsuit challenging Yale College’s admissions practices,” spokesperson Karen Peart stated. “We are also pleased that the Justice Department has withdrawn its notice of violation of Title VI and its notice of noncompliance.”
“Our admissions process has allowed Yale College to assemble an unparalleled student body, which is distinguished by its academic excellence and diversity. Yale has steadfastly maintained that its process complies fully with Supreme Court precedent, and we are confident that the Justice Department will agree,” Yale said.
The university claimed that the Trump Justice Department rendered its decision before Yale could produce the data the government had requested. “Had the department fully received and fairly weighed this information, it would have concluded that Yale’s practices absolutely comply with decades of Supreme Court precedent,” Yale said.
Yale is an exclusive, private university. Since it receives millions in federal funds, the university is subject to a provision of civil rights law that prohibits discrimination on the basis of race, color, and national origin as well as other factors.
