Sen. Marco Rubio (R-FL) isn’t budging on his opinion of former President Trump’s second impeachment trial. In an interview with Fox’s Neil Cavuto on Tuesday, Rubio said he still thinks it’s “stupid” and will hurt America deeply.
“It’s not even constitutional,” Rubio informed Cavuto. “Logic tells you that.” Cavuto seemed intent on placing blame on Trump for everything regardless of that logic. Rubio was one of 45 Republicans who voted to dismiss the trial as unconstitutional.
“The automatic consequence of impeachment and trial, if you’re convicted, the automatic consequence of it is you’re removed from office,” Rubio stated on “Your World” Tuesday. “That’s the automatic consequence of this process.”
“How can you put someone through a process where the automatic consequence is impossible?” Rubio asked. “You cannot remove Donald Trump from office [because] he’s not in office.” That brings to the forefront the contention by many scholars that the impeachment trial is unconstitutional because you can’t impeach someone who is no longer president.

Rubio bluntly declared: “There’s a lot of reasons why this is a terrible idea for the country. It’s not just a waste of time, but will hurt America.”
Then Cavuto twisted the facts to his purpose by asking: “Isn’t that of Donald Trump’s doing?”
Cavuto insinuated that Trump gave his approval for the riot on Capitol Hill when he tweeted on Jan. 6 that “[t]hese are the things and events that happen when a sacred landslide election victory is so unceremoniously & viciously stripped away from great patriots who have been badly & unfairly treated for so long.” Trump’s Twitter account had been banned and his comments removed.
Rubio responded to Cavuto: “Yeah, so if someone makes those remarks, he’s a private citizen. So he’s now — the reason why we have impeachment is the following; you can’t charge a president. So you have to remove them from office and then subject to criminal penalty. That’s why [former President Gerald] Ford pardoned [President Richard] Nixon because after he resigned, he could have still been prosecuted. If he did something that rises to that level and that these folks so strongly believe, then the criminal justice system and the civil system is in place to pursue.”

Cavuto wasn’t done trying to corner Rubio into declaring that Trump deserved impeachment. During the interview, he asked Rubio if he thought Trump’s language was incendiary enough to warrant impeachment and removal while he was still president.
Rubio indicated that Trump bore some responsibility in the incident but that he is also a private citizen now. He said the riot “was a foreseeable consequence” due to Trump’s words. Then Rubio again pointed out that it was up to the Justice Department, not Congress, to determine whether Trump committed wrongdoing while he was president.
The senator went on to make it clear that the only reason the impeachment is proceeding is that “this is what their base is demanding.”
“This is a country that’s already deeply divided,” he stated. “Politics has become very emotional. People literally hate each other in this country over politics. And now on top of that fire, we’re going to pour all of this gasoline and really get it going hotter … It’s all about the left’s demand for revenge.”
“Some of the people in the political entertainment business, this is about ratings and about clicks,” Rubio also pointed out.

Rubio stated that seeking to punish a president once out of office was “typical in the third world” and that it sets a very dangerous precedent.
“So there’s a lot of reasons why this is stupid and a terrible idea for the country,” he said, describing it as “a clown show” and “a joke.”
“It’s not just a waste of time but it’s going to hurt America,” he said.
In an interview with Fox News’ Chris Wallace on Sunday, Rubio said it was “arrogant” for Democrats to pursue a Senate conviction in order to bar Trump from running for office again.
“I think that’s an arrogant statement for anyone to make. Voters get to decide that. Who are we to tell voters who they can vote for in the future?” Rubio asked.
Senator Rand Paul also took umbrage at the impeachment of Trump: “It’s a farce, and it’s not constitutional, and it shows the double standards because Democrats have had much more hateful speech, much more specifically inciting violence, and no one said a peep about it.” He also told Fox News’ Maria Bartiromo that the impeachment was “a partisan game’ designed ‘to punish Republicans.”
