Cruz warns Biden has every intention of packing SCOTUS with full backing of ‘today’s Democrats’

U.S. Senator Ted Cruz warned that Democrats have every intention to pack the Supreme Court if Joe Biden gets elected and the first day of Amy Coney Barrett’s confirmation hearings proved it.

The Texas Republican told Fox News host Tucker Carlson that Monday’s opening statements by Democrats during the Senate Judiciary Committee’s confirmation hearings show their intentions on “court-packing” and expanding the size of the high court once they are in power.

“Today’s histrionics were all about setting the predicate to pack the court,” Cruz said on “Tucker Carlson Tonight” Monday.

“There’s a reason Joe Biden, Kamala Harris refuse to answer that question, because their answer is yes, they intend to pack the court. They intend it as a partisan power grab,” he added, noting how the very term is being redefined by Democrats in an effort to spin their narrative.

“They know that that’s not popular with the voters so they’re trying to hide it and part of the way they’re trying to hide it is claim everything else is illegitimate and they’re trying also to redefine what packing the court means,” Cruz said. “So they’re saying nominating judges when there are vacancies and confirming them, suddenly that’s packing the court.”

The GOP Senate Judiciary Committee member pointed to how Democrats pushed back in 1937 when President Franklin Roosevelt tried to increase the number of Supreme Court justices to 15.

“His own party resisted. His own party refused to do it. The Democrats had control of Congress. They said it would destroy the independence of the judiciary, it would destroy the Supreme Court, it would make it just another political body, and so they said no,” Cruz explained.

“Now, today’s Democrats are much more radical than the Democrats used to be,” he added.

Biden and his running mate Sen. Kamala Harris have refused to go on record with their stand on the court-packing issue though many other Democrats have had no problem doing so. The Democratic presidential nominee even declared last week that voters would have to elect him first before he would reveal where he stood on the issue.

In Ohio on Monday, Biden told a reporter he was not a “fan” of the idea.

“I’m not a fan of court-packing, but I don’t want to get off on that whole issue,” he told WKRC. “I want to keep focused. The president would love nothing better than to fight about whether or not I would in fact pack the court or not pack the court. The focus is why is he doing what he’s doing now.”

Biden also claimed that the only reason the subject has been making headlines as a campaign issue is because the press is “fascinated with it.”

Carlson asked Cruz if he thought a Biden administration would follow through with packing the Supreme Court.

“I think they will do it if they win. I think they will have the votes, it will be a straight party-line vote,” he said, warning that Democrats winning the Senate back will also look to end the legislative filibuster, will admit the District of Columbia and Puerto Rico as states and will add four more senators to Congress.

“I think every Senate Democrat is in on the joke,” Cruz said. “They know that and it’s why Kamala refuses to answer it.”

But the lawmaker gave Carlson “a word of optimism” amid the dire warnings.

“Today was a very good day for two reasons. Number one, nobody laid a glove on Judge Barrett. They had no meaningful substantive criticism,” he said.

“Number two, the Democrats aren’t actually arguing their far-left radical agenda,” he continued.

“They didn’t want to talk today about their agenda to take away your religious liberty. They didn’t want to talk today about their agenda to have a government to censor and silence you and they certainly did not want to talk today about their agenda to erase the Second Amendment from the Bill of Rights,” Cruz asserted.

“I actually think that shows that these are important issues for us to lead on because they matter to the American people,” he added.
