Obama judges vacate Boston Marathon bomber’s death sentence: Survivor says ‘he needs to die’

A three-judge panel of two Obama appointees and one Reagan appointee vacated the death sentence of Boston Marathon bomber Dzhokhar Tsarnaev.

Tsarnaev was a radical Islamic terrorist, according to friends and neighbors. Even the judges who vacated Tsarnaev’s death sentence called him and his brother “radical jihadists bent on killing Americans.”

In their ruling, the federal appellate judges claimed that the jury in Tsarnaev’s 2015 trial could’ve been influenced by pretrial publicity surrounding his 2013 bombing, which killed three people and injured 260 others.

The panel said the trial judge failed to properly vet the jury to screen out any prejudice they may have had against the terrorist bomber.

The federal judges said Tsarnaev could still be sentenced to death, but only if the government pursues a new trial to determine his punishment.

“A core promise of our criminal-justice system is that even the very worst among us deserves to be fairly tried and lawfully punished,” the three-judge panel wrote. “To help make that promise a reality, decisions long on our books say that a judge handling a case involving prejudicial pretrial publicity must elicit ‘the kind and degree’ of each prospective juror’s ‘exposure to the case or the parties…But despite a diligent effort, the judge here did not meet the standard.”

The three judges who issued the ruling were:

  • Rogeriee Thompson, an Obama appointee who wrote the opinion
  • William Kayatta, also an Obama appointee.
  • Juan Torruella, a Reagan appointee who dissented in part.

The decision to vacate Tsarnaev’s death sentence ignited widespread outrage. Among those furious with the ruling was survivor Adrianne Haslet, a dancer whose leg was blown off in the 2013 terrorist attack.

Haslet pointed out that Dzhokhar Tsarnaev confessed that he and his brother had planned to plant another terrorist bomb in New York City after they completed the Boston Marathon bombing.

“I’m so livid at today’s ruling by the federal court,” Haslet wrote on Instagram. “The death penalty should be used in this particular case. This terrorist admitted in court that he was guilty of crimes committed against our country. He confessed, with his brother…that their plans were to drive to New York and bomb the city too. This terrorist gave the finger when asked if he felt guilty.”

Haslet underscored:  “He is a threat to all of us and he needs to die.”

Sixteen other people lost their limbs as a result of Tsarnaev’s attack.

Another survivor named Rebekah Gregory torched the decision. Gregory also lost a leg, thanks to Dzhokhar Tsarnaev’s terrorism.

Gregory tweeted: “People are sitting on death row for far less, and the US Appeals court chooses to overturn the sentence of this COWARD??! All this does is give him the attention he wants, and prolongs the nightmare we have been living the last SEVEN years. Disgusting.”

President Trump said the federal appeals court made a horrible decision that will waste more time and taxpayer money.

“I see in Boston, where you have the animal that killed so many people during the Boston Marathon,” Trump told reporters at the Tampa International Airport. “They just sent this conviction for the death penalty back to the lower courts so they’ll argue about that for a long time. It’s ridiculous.”

Meanwhile, Democrats like Senator Kamala Harris wants to let Tsarnaev vote in the November election.

Oscar-winning film director Oliver Stone is a lifelong liberal who endorsed Barack Obama in 2008. In 2013, Stone slammed Obama as a “snake” who had lied to the American people.

Stone said Obama enabled the 2013 Boston Marathon bombing by Muslim brothers Tamerlan and Dzhokhar Tsarnaev because authorities were told to spy on American citizens instead of terrorists.

“At the Boston Marathon, they were so busy tracking down potential protesters that they missed the bombers,” Stone said. “It’s never about terrorists [with Obama].”

In another interview, Oliver Stone called Obama “a wolf in sheep’s clothing” who violated Americans’ privacy more than any other president.

“Under the disguise of sheep’s clothing, he has been a wolf,” Stone said.
