Fox News opinion host Jeanine Pirro scored a legal victory against Black Lives Matter activist DeRay Mckesson, when his defamation lawsuit against her was dismissed in New York Supreme Court last week.
Mckesson sued Pirro in 2017, claiming she defamed him when she criticized him for inciting violence during a protest where a cop was hit in the face by a rock by angry Black Lives Matters protesters.
The injured police officer sued Mckesson and Black Lives Matter, but the lawsuit was dismissed after the presiding judge concluded that Mckesson was merely exercising his First Amendment right to free speech.
Ironically, Mckesson then turned around and sued Pirro after she stated HER OPINION that she believes the cop had a right to sue Mckesson, and that he had fomented violence with his anti-police rhetoric.
Judge: Chill Out, Pirro Was Merely Stating Her Opinion
This is what Judge Jeanine said on “Fox and Friends” that led to Mckesson’s lawsuit:
“DeRay Mckesson, the organizer, actually was directing people, was directing the violence…You’ve got a police officer who was injured…at the direction of DeRay Mckesson.
“DeRay Mckesson walks away with a hundred thousand dollars for an organization that is amorphous. We got a problem in this country.”
In a 21-page opinion dismissing Mckesson’s lawsuit, Judge Robert Kalish said Pirro merely expressed an opinion on “Fox and Friends.” And that did not amount to “defamation.”
“Looking and listening to the televised segment as a whole…this Court finds that Pirro’s statement’s describing the [lawsuit] qualify as a substantially accurate report of a judicial proceeding and therefore are absolutely privileged from liability for defamation.
“Viewing the entire video sequence as a whole, it is clear that Pirro is expressing her opinion that the plaintiff-officer should be allowed to pursue his civil complain against Mckesson on the theory that Mckesson may be held liable for the violent events that occurred during a demonstration that he allegedly led considering the allegations of the plaintiff-officer.”
Fans Still Furious at Fox News for Suspending Pirro
Meanwhile, Fox News fans are still furious at the network for suspending Judge Jeanine after she condemned sharia law and anti-Semitic Democrat Congresswoman Ilhan Omar.
Pirro was pulled off the air for the past two weekends. It’s unclear when (or if) she’ll return.
Ilhan Omar continues to stir controversy with her anti-American, anti-Israel comments. About 1,500 demonstrators protested a fundraiser Omar spoke at benefiting the Muslim activist group CAIR, the Council on American–Islamic Relations.
CAIR has significant ties with the Muslim Brotherhood and the jihadi terrorist groups Hamas and Hezbollah. In 2014, the United Arab Emirates designated CAIR a terrorist organization on par with ISIS and al Qaeda.
