The left is still trying to make sense of what conservatives knew all along about Supreme Court Justice Brett Kavanaugh.
Contrary to their hyper-dramatized fears about Kavanaugh’s appointment spelling the end of abortion rights, the new Justice joined with four liberal judges to turn down hearing a case that could have defunded Planned Parenthood at the state level.
Senior judicial analyst for Fox News, Andrew Napolitano, reiterated what many conservatives already knew about Kavanaugh as he faced the relentless attacks from the left: He makes decisions “based on the law “and will do “what he believes is the right thing.”
“This is a technical issue about the standing of a person to sue a state. This is not on the merits of whether or not Louisiana must spend this money,” Napolitano said on Fox News’ “The Story with Martha MacCallum” on Monday.
The Supreme Court voted not to take an appeals case involving Louisiana and Kansas seeking to cut off Planned Parenthood from receiving Medicaid funding. The decision on Monday was over the technical issue of whether a Medicaid recipient could challenge the decision to disqualify a provider under the Medicaid law.
Napolitano reminded viewers that Kavanaugh’s vote to not hear the case should not come as a surprise to conservatives who were well aware of his commitment to uphold settled law.
“I have to say the right to life community, Brett Kavanaugh may very well be one of you but on the court, he makes a decision based on the law,” he said. “Assume that he is doing what he believes is the right thing.”
Liberals quick to mock conservatives over Kavanaugh’s decision to side with the liberal justices on the high court found the inevitable face-plants unavoidable.

Adam Best, founder of the blog FanSided, stepped on a rake as he took a jab at conservatives over Kavanaugh’s decision Monday.
Kavanaugh was confirmed despite being unfit because the GOP wanted him to legislate a conservative agenda from the bench. They must be shocked that he didn’t vote with Alito, Gorsuch and Thomas on Planned Parenthood. Gotta hate it when your far-right rubber stamp malfunctions!
