Prosecutors interview James Comey as they consider charging Andrew McCabe for lying to feds

Investigators have questioned former FBI Deputy Director Andrew McCabe’s direct superior during his time at the bureau, as part of a probe into whether McCabe broke the law and misled federal agents, The Washington Post reported Thursday.

Investigators with the D.C.-U.S. Attorney’s Office spoke to former FBI director James Comey about allegations McCabe knowingly mislead federal agents, as well as Comey himself, over authorizing leaks to the media. If charged and found guilty, McCabe faces a five-year prison sentence for deceiving federal agents four times — including three times under oath.

Comey’s questioning is a reflection of the seriousness with which investigators are approaching the McCabe case, according to WaPo.

“A little more than a month ago, we confirmed that we had been advised that a criminal referral to the U.S. Attorney’s Office had been made regarding Mr. McCabe,” McCabe lawyer Michael R. Bromwich told WaPo in a statement. “We said at that time that we were confident that, unless there is inappropriate pressure from high levels of the Administration, the U.S. Attorney’s Office would conclude that it should decline to prosecute. Our view has not changed.”

McCabe has consistently denied he mislead anyone while in his position.

Justice Department Inspector General Michael E. Horowitz accused McCabe in April of breaking federal law and misleading agents. Horowitz’s allegation does not guarantee charges will be brought, however.

Attorney General Jeff Sessions fired McCabe on March 16, on the Justice Department’s recommendation. McCabe was fired two days before he was set to retire.
