Denver sheriff defies ICE detainment request for illegal immigrant arrested in fatal hit-and-run

An illegal alien arrested for a fatal hit-and-run accident in Colorado is under the protection of the Denver sheriff after ICE authorities issued a detainment request for the suspect.

The suspect, 26-year-old Ivan Zamarripa-Castaneda, allegedly drove away from the scene of a crash between a semi-tractor trailer and a pickup truck on Interstate 70. The collision ignited a fire and the semi driver was killed in the incident.

“An illegal immigrant and suspect in a deadly hit-and-run accident in court today and could be back out on the streets if he posts bail,” Fox News’ Trish Regan reported. “ICE agents issued an immigration detainer in an effort to arrest and deport the suspect. Colorado officials have refused that detainer. ”

“That suspect was in court today charged with vehicular homicide and leaving the accident and he is also suspected of drunk driving,” reported Alicia Acuna. “Take a look at the video of this aftermath.” [Rolls video, above]

“Denver police say Ivan Zamarripa-Castaneda crashed into a semi-truck on Interstate 70, an action that resulted in in this fire,” she continued. “The driver of that semi, a 57-year-old man, trapped inside his cab. The 26-year-old suspect in this country illegally took off, leaving that man to die.

U.S. Immigration and Customs Enforcement agents want to deport him and they sent a civil detainer request to the Denver Sheriff Department, which is refusing,” Acuna reported.

The Denver Sheriff Department told Fox News: “The Denver Sheriffs Department will not honor civil detainers as it is considered ‘unconstitutional.'”

“So, unless ICE gets a federal judge to sign a warrant, Denver won’t hand this guy over,” Acuna continued. “If he posts the $25,000 bond he will be free until his court date. Denver has not honored civil detainers since 2013.”

“The city will let ICE know if this guy is released. But as ICE has pointed out to Fox,  they use these civil detainers to keep these types of people off the streets and the public safe,” she added.

ICE is increasingly meeting resistance from state authorities. Attorney General Jeff Sessions has led a Department of Justice lawsuit against the State of California for its “sanctuary cities” policies.

Meanwhile, many Democrats are spearheading a movement to have Immigration and Customs Enforcement abolished.
