ACLU sues Catholic hospital for refusing to perform ‘transition’ surgery on transgender man

Hasn’t anyone on the left learned anything from the Hobby Lobby and Little Sisters of the Poor cases? It’s all about “sincerely held religious beliefs.”

The American Civil Liberties Union filed a lawsuit last week against Dignity Health’s Mercy San Juan Medical Center, a private Catholic hospital in Sacramento, California.

The ACLU brought the suit on behalf of Evan Minton, a transgender male who was born female, according to local NBC affiliate KCRA 3 News.

In August of last year on the day before Minton was scheduled for a hysterectomy, he mentioned to the medical staff for the first time that he was a transgender male and preferred to be addressed as such.

The procedure he was scheduled to undergo was a necessary step in transitioning from a woman to a man.

The following day the hospital cancelled the procedure, citing “Catholic religious and ethical directives,” and offered to transfer him to a different facility. But apparently that wasn’t good enough for Minton.

“We feel very clearly that they discriminated against me because I’m transgender — and that is against the law,” Minton said.

The lawsuit alleges that the medical facility was in violation of “sex discrimination in violation of California’s Unruh Civil Rights Act,” and at least one local defense lawyer believes Minton has a case.

“It kind of goes back to the whole ‘separate but equal’ years ago, where it was OK to discriminate, but as long as you provide something that was equally balanced,” attorney Johnny Griffin told the station. “So, this is why this is an area of the law that needs to be settled by the courts.”

Because Dignity Health hadn’t been served with the complaint, it said it couldn’t respond directly to the allegations in the lawsuit, but did release a general statement.

“What we can share is that at Dignity Health Mercy San Juan Medical Center, the services we provide are available to all members of the communities we serve without discrimination. We understand how important this surgery is for transgender individuals, and were happy to provide Mr. Minton and his surgeon the use of another Dignity Health hospital for his surgery within a few days,” the statement said.

“We do not provide elective sterilizations at Dignity Health’s Catholic facilities in accordance with the Ethical and Religious Directives for Catholic Health Care Services (ERDs) and the medical staff bylaws.”

Folks on social media saw it as another example of far-left lunacy replacing common sense.

And that’s it, isn’t it? One can’t help but wonder if choice of a Catholic facility for the procedure was an act of shopping for a defendant with deep pockets.
