There are times when criminal defense lawyers must feel soulless.
Fox News host Tucker Carlson, “the sworn enemy of lying, pomposity, smugness, and groupthink,” took on the lawyer handling the defense of an illegal immigrant who allegedly raped a girl four years his junior in a Rockville, Maryland high school bathroom last week.
Carlson briefly outlined the latest developments in the case in which Henry Sanchez-Milian, 18, along with another illegal immigrant, stands accused of brutally raping the ninth-grader.
The Fox News personality played news footage of David Moyse, Sanchez-Milian’s attorney, claiming the attack was consensual. He reiterated that claim to Carlson.
“The preliminary indication we have is that this was a consensual encounter — not a rape in any sense,” he told the Fox News host.
“Between two guys, 17 and 18 and a 14-year-old-girl in a high school bathroom,” Carlson said in disbelief. “Pardon me if I seem astonished that you would be bold enough to assert something like that. That seems insane.”
“The focus right now as an attorney, as a human being, is making sure that our children are protected, making sure that the bottom line of this story is found out,” the lawyer said.
Carlson, apparently focusing in on Moyse’s protection of children claim, asked if he’d feel comfortable having his 14-year-old daughter sit in class with his client.
After stating that he wants “nothing but safety for my children, their friends, my family,” he admitted that the allegations against his client are “horrific,” but added that there “could be a number of questions asked about all three of the people involved in this” case — including the accuser.
Moyes observed that by making her accusation, the girl placed her own character into play.
“Man, you better be right about this if you’re good to be impugning the character of a 14-year-old girl who says she was raped,” Carlson exclaimed. “Other people said they heard her screams. To impugn her character, you really before God better be sure that you are on the right side of this.”
Moyse said it’s all a part of the system of American jurisprudence.
“I think what occurs to me is that we have a system here,” he replied. “When people are accused, we go through the system.”
Carlson shot back that he didn’t need to “trash the accuser.”

“Have you thought through the moral consequences?” Carlson asked. “I know you play a role and I’m glad defense lawyers exist. But before you say something like that, do you think, ‘Man, I’m kind of putting my soul on the line a little bit?’”
Moyes admitted to having “all those thoughts.”
On the same show, Carlson also blasted the school superintendent who apparently wanted to protect the feelings of illegal immigrants over protecting teenage girls from rape.
