A state law binding Republican delegates to back presumptive GOP nominee Donald Trump is being challenged by a Virginia delegate to the party’s National Convention.
Carroll B. Correll filed a lawsuit Friday seeking class action status on behalf of the commonwealth’s 49 Republican delegates and 110 Democratic delegates, Fox News reported. Correll served as a co-chair for Texas Sen. Ted Cruz’s campaign in Virginia’s 10th congressional district.
Trump won Virginia’s primary in March, garnering 17 delegates. But Correll said Trump is “unfit to serve” as president in his complaint and claims Virginia’s law violates his right to free speech.
The law in question states: “Delegates and alternates shall be bound to vote on the first ballot at the national convention for the candidate receiving the most votes in the primary unless that candidate releases those delegates and alternates from such vote.”
Correll is seeking an injunction to exempt him from criminal penalties or even legal action by Trump for backing another candidate on the first ballot, according to Fox.
He and his attorneys hope to have a ruling from the court by the start of the convention in Cleveland July 18.
