A 61-year-old Bronx man is facing serious criminal charges after beating his wife’s much younger would-be rapist with a tire iron.
Police arrested Mamadou Diallo Tuesday morning and charged him for the death of career criminal Earl Nash, 43, after Nash forced his way into the Diallo apartment and began assaulting his wife.
The confrontation reportedly occurred outside the apartment, in an elevator servicing the building, according to The New York Daily News.
The two came to blows when Diallo was exiting the elevator and Nash was scurrying out of the apartment after Diallo reportedly received a call from his wife telling him of the attack.
“While it was going on, I was thinking I was going to die,” the wife told the Daily News about the ordeal that left her naked and terrified in the hallway. “I told my husband, ‘Don’t let him out!’”
At that point Diallo chased Nash into an elevator, where, according to witnesses, Diallo beat Nash with the tire iron, and Nash beat the older man with his belt.
Nash was later taken to Lincoln Hospital where he died from severe body and head trauma.
The wife said that when she heard pounding on the front door at about 9:00 p.m. Monday night, she thought it was her son. But when she opened the door she was greeted by Nash instead. He forced his way in and began removing his clothes.
“I’ll give you money,” the wife said.
“I don’t wan’t money,” Nash told her, according to the wife. “I’m going to rape you.”
The Daily News reported:
The wife told The News that Nash then tore off all her clothes and bashed her repeatedly in the head with a chair as she fought for her life.
Diallo’s brother insisted that Nash instigated the lethal brawl.
“The guy punched him, he started fighting,” Ibrahima Diallo, 52, told the Daily News. “… This man said he’s gonna kill him, kill his family.”
Diallo enjoys a good reputation in the community.
“He’s a good guy,” a friend, who asked not to be named, said of Diallo, according to DNA Info. “He’s been in this country 27 years and never had a problem,”
The same can’t be said of Nash. DNA Info reported:
Nash has been arrested 14 times since 1997, and there is no indication that he knew the Diallos before the attack, according to the NYPD.
In 2006, he was convicted for selling drugs and bribery, according to prison records. He was released in February 2011, but returned to prison on a parole violation the next April, a pattern he repeated until July 2015, a Department of Corrections spokesman said.
Nash was arrested in September 2015 for harassment and criminal contempt, court records show. He was briefly held on $1,500 bail but released after four days, records show.
About a month later, Nash was arrested again for selling drugs, records show. He was held on $3,000 bond, which he paid Dec. 23, records show.
Then in December, the court ordered he be held on $1 bail in the harassment case, which he hadn’t posted, records show. It wasn’t clear why he was out of custody.
He was arrested again May 14 for trespassing, a parole violation, but then released six days later, jail records show.
