The odds of a Republican presidential candidate testifying in court during campaign season just increased.
The case against Donald Trump for fraud in his former real estate school will now go to trial, a New York judge ruled on Tuesday, according to Fox News.
Though it is not clear yet if the case will be weighed at a jury trial, something Trump favors, New York County Supreme Court Judge Cynthia Kern made the decision Tuesday. Trump may testify at the trial that could take place this fall, according to Trump’s attorney Jeffrey Goldman.
New York Attorney General Eric Schneiderman has accused Trump of misleading students using “bait-and-switch” tactics, luring them into expensive seminars while enrolled in Trump University. Schneiderman, a Democrat, alleged that the school, which promised lessons by experts in the real estate field who were hand-picked by Trump, was unlicensed since its beginning in 2005.
Schneiderman’s suit for $40 million seeks restitution and damages for more than 5,000 students across the nation, including 600 New Yorkers, who paid up to $35,000 each, according to Fox. Trump has denied the charges, claiming a 98 percent approval rating by students and accused Schneiderman of pursuing the case to wring out campaign contributions from Ivanka, Trump’s daughter. Schneiderman denied it, and Ivanka’s $500 donation in 2012 was returned by his campaign.
Litigation against Trump University, which changed its name to Trump Entrepreneur Initiative before closing in 2010, has been a source of attacks by the GOP front-runner’s rivals in the election race.
