In a letter dated February 2 but made public Monday, one day before the New Hampshire primary, the FBI confirmed that its investigation into Hillary Clinton’s use of a private server to conduct official business is “ongoing.”
The letter, from FBI General Counsel James Baker to Department of State acting legal advisor Mary McLeod, was made public through a Freedom of Information Act request.

Late last year, FBI Director James Comey confirmed for the first time that his agency was investigating Clinton’s private email account and “the possible exposure of classified information through that account,” Politico reported.
As for a political motive behind its investigation, Comey added, “If you know my folks, you know that they don’t give a rip about politics.”
Although the letter is silent on whether or not it’s a criminal investigation, government sources have indicated in the past that the agency seldom involves itself with non-criminal matters.
“The DOJ [Department of Justice] and FBI can conduct civil investigations in very limited circumstances,” but that’s not what this is, an FBI source told the New York Post in August. “In this case, a security violation would lead to criminal charges.”

“[The FBI is] not in the business of providing advisory security services,” Makin Delrahim, former chief counsel to the Senate Judiciary Committee, who served as a deputy assistant secretary in the Bush Justice Department told the New York Post last year. “This is real.”
