
New records released pertaining to the “modern Watergate,” Arctic Frost, prompted allegations of then-Special Counsel Jack Smith “illegally” working in concert with leftist judges.
Tuesday in Washington, D.C., Texas Sen. Ted Cruz (R) presided over a Senate Judiciary Subcommittee hearing pertaining to the Biden-era FBI operation that involved spying on members of Congress and others. As part of the hearing, the committee released new records that have led some to suggest Smith was coordinating his strategy against President Donald Trump and his allies with U.S. District Court for the District of Columbia Judges James Boasberg and Beryl Howell.
Following Iowa Sen. Chuck Grassley’s (R) release of the 30 pages of records as chair of the Senate Judiciary Committee, journalist Julie Kelly emphasized how, “it appears Special Counsel Jack Smith conferred with both DC Chief Judges Beryl Howell and James Boasberg on their legal strategy in targeting the president and his associates. This relates to a Jan 2023 briefing with [then-Attorney General Merrick] Garland.”
The post included a screenshot with a highlight beneath a redacted portion that read in regard to a meeting with Howell, “She liked our approach of pursuing the executive privilege litigation in an omnibus fashion … Judge Boasberg = March 18.”

During the hearing, Cruz addressed the scope of Arctic Frost, comparing it to the defining scandal of President Richard Nixon’s administration: “And if Watergate taught us anything, it is that even a single abuse of power — carried out by a handful of individuals — can shake the foundations of our Republic.”
“But what we confront today — the Biden Administration’s Arctic Frost scheme — is not a single act. It is a modern Watergate — trading a break-in at one office for a digital sweep into approximately 100,000 private communications, more than a dozen senators, and thousands of individuals’ lives,” continued the lawmaker. “But even that comparison falls short. It is something far broader: an operation that aligned Democrats across all three branches of government.”
As had been reported, records released by Grassley also showed how Howell and U.S. Magistrate Judge James Mazzone signed nondisclosure orders, concealing two Smith subpoenas that sought roughly two years of phone records of now-FBI Director Kash Patel.
The Senate committee also highlighted a list included in the records of lawmakers that “they wanted to target. Smith’s team already knew these Members had communicated with President Trump’s inner circle. They subpoenaed the Members’ private records anyway.”

“We have long known that Judge Boasberg is a far-left judicial activist trying to undermine the President’s lawful authority. This is just further proof,” said White House Deputy Press Secretary Abigail Jackson in a statement. “President Trump has restored integrity to the Department of Justice that Joe Biden and his administration weaponized to target their political opponents — including President Trump himself.”
Regarding the latest release, tempered by attorney Bill Shipley who suggested the memo was “clearly” meant to catch Garland up on the case after the holidays before decrying Howell for her desire “to resolve all the issues involving witness privilege before she stepped down as Chief Judge,” reactions on social media circled back to asking when anyone might be held accountable for their alleged wrongdoing.
This memo also needs to be read in context of the specific month in which it was written.
