
The Department of Justice has filed a formal complaint against U.S. District Court Chief Judge James Boasberg, accusing him of misconduct over improper remarks about President Donald J. Trump made during a judicial conference in March.
Boasberg has been assigned to several high-profile challenges to Trump’s policies, one of them the deportation of Tren de Aragua and MS-13 gang members to El Salvador, where they are housed at the country’s maximum security terrorist prison. Earlier this year, the activist judge demanded that deportation flights be turned around and is considering holding DOJ lawyers in contempt because his orders weren’t followed.
The complaint alleges that Boasberg made inappropriate comments at a March 11 meeting of the Judicial Conference, which is presided over by Supreme Court Chief Justice Roberts, predicting that Trump would trigger a “constitutional crisis” by disregarding federal court rulings.

“Today at my direction, @TheJusticeDept filed a misconduct complaint against U.S. District Court Chief Judge James Boasberg for making improper public comments about President Trump and his Administration,” Attorney General Pam Bondi said in a Monday post to X. “These comments have undermined the integrity of the judiciary, and we will not stand for that.”
The complaint, which is addressed to the United States Court of Appeals for the District of Columbia Circuit, Chief Judge Sri Srinivasan, was written by Bondi’s Chief of Staff Chad Mizelle.
“The Department of Justice respectfully submits this complaint alleging misconduct by U.S. District Court Chief Judge James E. Boasberg for making improper public comments about President Donald J. Trump to the Chief Justice of the United States and other federal judges that have undermined the integrity and impartiality of the judiciary,” the complaint says, according to Fox News.
“On March 11, 2025, Judge Boasberg attended a session of the Judicial Conference of the United States, which exists to discuss administrative matters like budgets, security, and facilities,” Mizelle wrote. “While there, Judge Boasberg attempted to improperly influence Chief Justice Roberts and roughly two dozen other federal judges by straying from the traditional topics to express his belief that the Trump Administration would ‘disregard rulings of federal courts’ and trigger ‘a constitutional crisis.’”
“Although his comments would be inappropriate even if they had some basis, they were even worse because Judge Boasberg had no basis—the Trump Administration has always complied with all court orders. Nor did Judge Boasberg identify any purported violations of court orders to justify his unprecedented predictions,” the complaint says.
“Within days of those statements, Judge Boasberg began acting on his preconceived belief that the Trump Administration would not follow court orders. First, although he lacked authority to do so, he issued a temporary restraining order preventing the Government from removing violent Tren de Aragua terrorists, which the Supreme Court summarily vacated,” the complaint states, adding that “Taken together, Judge Boasberg’s words and deeds violate Canons of the Code of Conduct for United States Judges, and, erode public confidence in judicial neutrality, and warrant a formal investigation.”
“Judge Boasberg first tried to persuade Chief Justice Roberts and other federal judges that the Trump Administration would not follow court orders, despite having no basis for his belief. Then he acted on his baseless belief again and again in litigation over which he was presiding,” Mizelle wrote in a Monday post to X.

“Judge Boasberg violated the Canons of the Code of Conduct for United States Judges, including the requirement that he ‘promote public confidence in the integrity and impartiality of the judiciary.’ Today, at the direction of the Attorney General, DOJ filed a judicial misconduct complaint against him,” he added. “Federal judges often complain about the decline of public trust in the judiciary. But if the judiciary simply ignores improper conduct like Judge Boasberg’s, it will have itself to blame when the public stops trusting it.”
