SiriusXM’s Megyn Kelly said Tuesday on her podcast that she doesn’t “really give a shit” about illegal migrants’ due process after former President Joe Biden opened the U.S. southern border to millions.
The border crisis became a major issue for then-President Biden and then-Vice President Kamala Harris during their respective 2024 campaigns against current President Donald Trump, with Trump repeatedly vowing mass deportations. Kelly, discussing Trump’s Department of Justice (DOJ) court battle with a D.C. judge over deportations, said Americans are fed up with the border crisis.
“Joe Biden opened the border, and millions of very bad hombres crossed the southern border [and] are in the United States right now and will kill, rape, and hurt our children, ourselves, our neighbors, and we don’t care,” Kelly said on “The Megyn Kelly Show.”
“I’m really at the point like, get out! Get out. I don’t really give a shit about your due process. What due process did the rest of us have?” Kelly asked.
Kelly played a clip of border czar Tom Homan on ABC’s “This Week,” where he clashed Sunday with host Jonathan Karl over the Trump administration’s push to deport members of the Venezuelan gang Tren de Aragua (TdA).

“Due process — where is Laken Riley’s due process? Where are all these young women killed and raped by members of the TdA? Where was their due process? The young woman on the subway, where is her due process?” Homan asked Karl during the interview.
On March 15, Trump invoked the Alien Enemies Act of 1798 against the TdA, allowing its members to be immediately arrested and removed from the U.S. as “Alien Enemies.” That same day, the president deported over 200 migrants to El Salvador, prompting U.S. District Judge James E. Boasberg to attempt a temporary halt on the deportations.
Boasberg declared an emergency hearing that evening, expanding his order to say that “all noncitizens in U.S. custody” were not to be deported. While he verbally suggested that any deportation flights already departed should be returned, he did not include it in his written order, according to CBS News.
Since the order, Boasberg has asked whether the Trump administration purposely defied his ruling after more than 200 migrants were confirmed to have landed in El Salvador on the morning of March 16. The case has since been brought to the U.S. Court of Appeals for the D.C. Circuit.
A panel of D.C. judges heard oral arguments Monday, with Circuit Judge Patricia Millett drawing media attention after telling Trump administration officials there “were no procedures in place to notify people,” before adding that Nazis were treated better under the Aliens Act.
The panel is expected to give the DOJ a decision in the coming days, according to ABC News.
