Mike Davis, who clerked for U.S. Supreme Court Justice Neil Gorsuch, appeared Friday on Fox News and said that President Donald Trump made the right call to revoke former President Joe Biden’s security clearance.
Trump announced on social media that he is revoking the security clearances of Biden and ending his daily intelligence briefings. During an appearance on “The Ingraham Angle,” Davis said this action is a necessary measure.
“The president of the United States is the commander in chief under our Constitution, and he gets to control who gets classified information and who does not. And so President Trump correctly made the determination that President Biden could not be trusted with classified information with his cognitive failure along with his mishandling of classified records,” Davis told Laura Ingraham.

“Before he had five stashes of stolen classified records from his time as vice president moved several times, accessible by his employee who was a Chinese agent and may be used by Hunter Biden to secure Ukraine funding, so I think President Trump made the right decision here,” Davis said.
Davis said it’s important to safeguard national interests over political considerations.
“You had the Biden Justice Department with Special Counsel Robert Hur who came to a finding that Biden is not mentally fit, and so he should not have classified information,” Davis said.
Special Counsel Robert K. Hur’s investigation into Biden’s handling of classified documents said that, after his vice presidency, Biden intentionally kept and shared classified materials as a private citizen. These materials included documents and notes related to military and foreign policy, especially concerning Afghanistan.
During a hearing about his management of these documents, Biden insisted on his commitment to properly handling classified information. Yet the hearing transcript said Biden sometimes had difficulty remembering specific dates and details. He also said he was unaware about the documentation process for some of the sensitive documents he handled.
Dr. Marty Makary, a professor at Johns Hopkins School of Medicine, has previously said Biden seems to show signs of dementia and cognitive decline. For a long time, mainstream media outlets minimized questions about Biden’s cognitive health. These issues, however, came to the forefront following his debate with Trump. During a segment on Fox News, Makary said that the president’s behavior during the debate displayed “signs of cognitive slowing.”
Even Democratic donors were worried about Biden’s mental state, as reported in journalist Bob Woodward’s latest book called “War.” The book documents how these concerns, first voiced in June 2023, foreshadowed Biden’s subsequent difficulties in a nationally televised debate with Trump, ultimately leading to his replacement on the ticket by former Vice President Kamala Harris.
