Judge Juan Merchan on Monday denied President-elect Donald Trump’s request to postpone his sentencing, scheduled for Friday, as stated in a court filing.
This prompted a last-minute appeal as the President-elect attempts to halt the proceedings, according to the court filing. Earlier on Monday, Trump’s attorneys asked the same appellate court to overturn two of Merchan’s recent decisions that confirmed his conviction in the case. They requested the judge to delay Trump’s sentencing while the appeal progresses.

“This Court has considered Defendant’s arguments in support of his motion and finds that they are for the most part, a repetition of the arguments he has raised numerous times in the past,” Merchan wrote in the court ruling.
In their recent court filing, Trump’s attorneys requested that the court cancel the sentencing hearing set for Jan.10 and halt all case deadlines until Trump’s appeals regarding presidential immunity are resolved, which they argue should lead to the case’s dismissal. They said that the charges, which they described as baseless, should not have been filed.
Last week, Merchan hinted that he would not issue a jail sentence, suggesting that an “unconditional discharge” might be the most suitable outcome.
Trump’s attorneys commented on the situation.
“While it is indisputable that the fabricated charges in this meritless case should have never been brought, and at this point could not possibly justify a sentence more onerous than that, no sentence at all is appropriate based on numerous legal errors—including legal errors directly relating to Presidential immunity that President Trump will address in the forthcoming appeals,” Trump’s attorneys wrote in the filing.
