Jordan Neely’s dad hits Daniel Penny with lawsuit as jury decides his fate

As a New York jury decides whether the actions taken by Marine veteran Daniel Penny meet the requirements for manslaughter, Jordan Neely’s dad has finally entered the picture.

Neely passed away after being held in a chokehold by Penny after he allegedly threatened and disturbed a subway car full of straphangers, and his father is now looking for a large sum of money as compensation for his son’s loss.

Andre Zachary, the father, filed the suit with the New York Supreme Court demanding “judgment awarding damages in a sum which exceeds the jurisdictional limits of all lower Courts which would otherwise have jurisdiction.” The filing comes as a jury is deciding Penny’s fate following a four-week trial in Manhattan.

As BizPac Review reported, bodycam footage from the aftermath of the incident reveals that bystanders who witnessed the struggle between Neely and Penny sided with the veteran, saying he treated Neely “really respectfully.”

“The whole train was freaked out he was either gonna pull a gun, a knife…” said one woman. Another quoted Neely saying “I’m willing to die” several times.

The first woman also noted that Penny, who she called “the guy in the tan,” took Neely down “really respectfully.”

“He just like held him down, he didn’t choke him,” the women agreed.

The second woman would later go into detail, describing Penny’s actions as “a chokehold, not a hard chokehold, just enough to secure him. And the guy [Neely] fought, and he [Penny] kept holding him.”

She mused that Neely may have been on drugs at the time of the incident, as his behavior was “off the charts. He scared the living daylights out of everyone.”
