Attorney General Merrick Garland’s Department of Justice has offered what Judicial Watch has called an “unprecedented assertion” that the audio recording of President Joe Biden’s interview with Special Counsel Robert Hur should be kept from the public because “AI” — artificial intelligence — could be used to alter Biden’s words.
The 81-year-old president was described as an “elderly man with a poor memory” in Hur’s report on Biden’s mishandling of classified documents and the White House “is fighting a rearguard action” to keep the audio tape of Biden’s interview secret, according to the Daily Mail — the president is making extraordinary assertions of executive privilege.
“If the audio recording is released, it is easy to foresee that it could be improperly altered and that the altered file could be passed off as an authentic recording and widely distributed,” Associate Deputy Attorney General Bradley Weinsheimer reportedly wrote in a court filing on Friday.
As noted by the British newspaper, a transcript of the interview revealed that Biden said “I don’t recall,” “I don’t remember,” and “I have no goddamn idea” more than 100 times. The president was also unable to recall the year his son Beau died and when Trump was elected, and he cracked jokes throughout.
RealClearInvestigations reporter Paul Sperry posted a breaking news report Sunday afternoon that adds to the intrigue of what’s on the tape.
Sperry reported on X: “Attorney General Merrick Garland has classified at the highest level the audio tapes of Biden’s embarrassingly incoherent interview with Special Counsel Hur over two days, and has locked the tapes away in a Sensitive Compartmented Information Facility, or SCIF.”

Even more troubling, given that the inability to trust three-letter agencies in DC is all but nonexistent in a post-Obama America, are reports that the audio has been “cleaned up.”

Judicial Watch filed a FOIA lawsuit against the DOJ in March for failing to respond to requests for the tape, and filed a new lawsuit on Friday in response to the “AI” argument, which it called a “disturbing development.”
“Wow. Judicial Watch’s FOIA lawsuit forced the Biden team to admit what everyone suspected – that the transcript is not accurate and was changed in a way to help Biden,” Judicial Watch President Tom Fitton said in a release. “There is nothing ordinary about this, and the transcript inaccuracy issues seem to help Biden’s political campaign needs. We, today initiated a new FOIA request on this Biden’s Nixonian tape scandal.”
The House Oversight and Judiciary committees voted to hold Garland in contempt for his refusal to abide by subpoenas for the audio of Biden’s five-hour interview.
Hur’s investigation found that Biden had “willfully retained classified materials after the end of his vice presidency when he was a private citizen,” but he opted not to prosecute arguing that no jury would convict.
“At trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,” Hur explained.
