Former President Trump is reportedly suing the New York judge overseeing the Stormy Daniels hush money case filed against him by Manhattan District Attorney Alvin Bragg over a gag order imposed on him.
The criminal trial is set to begin next week, and the New York Times reported that a Trump proceeding “indicated that he planned to file an unusual type of lawsuit against the judge overseeing the case, Juan M. Merchan.”
Merchan’s gag order cited Trump’s “uncontested record” of attacks and has significant implications for the former president’s actions. The order bans him from making any attacks on witnesses, prosecutors, jurors, court staff, and their relatives. Last week, the order was expanded to include the judge’s family. Notably, Merchan and Bragg are exempt from the order.

Two people with knowledge of the matter said that Mr. Trump’s lawyers on Monday had planned to file the action calling on the appeals court to overturn a gag order that Justice Merchan recently imposed on the former president. The order prevents Mr. Trump from attacking witnesses, prosecutors and the judge’s own family.
Court records showed on Monday that Mr. Trump had begun the process of filing the action against Justice Merchan, though the papers were not immediately made public.
The Times described the reported lawsuit as an “unorthodox move, essentially an appeal in the form of a suit,” and suggested that it was “unlikely to succeed, particularly so close to trial.”
In a separate proceeding, an appeals court judge on Monday rejected Trump’s 11th-hour request to delay the start of the trial in New York, which is reportedly the only criminal case out of four filed against the presumptive Republican presidential nominee to make it to trial this year.
Trump succeeded in delaying the trial once, from March 25 to April 15, after his legal team complained that evidence related to the case was turned over late after they subpoenaed the Department of Justice for documents related to the case, according to CBS News
While Trump’s lawyers blamed Bragg for the issue, Judge Merchan concluded Bragg’s office wasn’t at fault.
The network noted that Trump’s lawyers “have previously argued that he can’t get a fair trial in Manhattan, citing a survey they commissioned of 2,000 New Yorkers, which they said showed Trump’s favorability is far higher among residents outside New York City.”
