Frank Siragusa filed a lawsuit Monday in federal court accusing Taco Bell of false advertisement over the fast food chain’s Crunchwrap and Mexican Pizza menu items.
The class action suit was filed in the Eastern District of New York and claims that Taco Bell “materially overstates the amount of beef and/or ingredients” in its ads, according to NBC News. Siragusa purchased a Mexican Pizza on Sept. 20, 2022, that he alleges “contained approximately half of the beef and bean filling that he expected.”
“Taco Bell’s actions are especially concerning now that inflation, food, and meat prices are very high and many consumers, especially lower income consumers, are struggling financially,” the lawsuit said.

Being that it was “Taco Tuesday,” CNN’s Tom Foreman reported on the false advertising lawsuit the following day with a focus on the photos seen above.
“Well, what’s happening is that this customer is very unhappy up in New York, that what they’re seeing in the ads and on the menu is not what they’re getting. Take a look at the documents they have in their order. The Crunch Wrap Supreme: there is what they’re promising, over here is what they saying they’re getting. Very different product,” Foreman said.
“Look at another one. You mentioned the Mexican pizza a minute ago, which I would argue might be grounds for a lawsuit from both Mexico and Italy,” he told host Brianna Keilar. “It’s not really pizza, but nonetheless, that’s what they’re promised and this is what they say they’re getting. And one of the big complaints here is, look at how small the amount is compared to over here. They say, ‘We think we’re getting half as much as we’re promised,’ and they are so upset about the lack of beef they even roped the vegans into it by looking at some of the vegan offerings and saying the vegan crunch wrap is even less than what we were offered before.”
“Bottom line is, they say it’s unfair to consumers out there,” Foreman said. “They say look, in some of the language in the particular argument here, they say, this is something, when the economy’s not doing well, the ‘actions are especially concerning now that inflation, food, and meat prices are very high and many consumers are struggling financially.’”
The law firm behind the Taco Bell lawsuit has filed similar suits against McDonald’s, Wendy’s, and Burger King, according to Foreman.
