A prominent conservative think tank is suing Manhattan District Attorney Alvin Bragg for failure to comply with the Freedom of Information Law (FOIL) by refusing to turn over information related to his prosecution of former President Donald J. Trump, who was indicted by his office in March and faces a trial in front of a hostile New York City jury.
On Monday, the Heritage Foundation filed two lawsuits against the George Soros-backed prosecutor regarding possible communications that his office may have had with the White House, the Justice Department, and congressional Democrats involving his case against the 2024 GOP frontrunner, which if it did occur would likely be something that Bragg would want to keep under wraps.
While it hasn’t received much media attention as of late, primarily due to the far more serious federal indictments facing the ex-POTUS that have dominated headlines, Bragg was the first to land the unprecedented legal blow on a former U.S. president and likely nominee of the opposition party with his 34 stacked felony charges in his case centering around a “hush money” payment to faded porn queen Stormy Daniels with Trump’s disgraced former attorney Michael Cohen also playing a key role.
“Regrettably, these questions have not been met with answers. These reports have raised concerns in many circles based in large part upon the longstanding history of President Trump’s political opponents coordinating their activities to systematically weaponize the criminal justice system against him and thereby pervert the course of Justice,” reads a filing for the first lawsuit.

A second lawsuit filed by Heritage alleges that the DA and his team retained pro bono assistance from major law firms specializing in white-collar cases. The organization is asking the court to make Bragg provide the documents and to bar his legal team from “seeking costs and fees for the request at issue in this case.”
The director of the foundation’s government watchdog arm said that there is a belief that the left-wing DA was “coordinating, or otherwise communicating” with the former president’s political foes and that Bragg was a “prolific communicator” by cellphone.
“The fact we have to file a lawsuit against Bragg who says he can’t produce these records and says he doesn’t have the systems to do so, is proof-positive of another dual standard of justice at play in this country,” Mike Howell of Heritage’s Oversight Project told Fox News Digital.
“You have a weaponized actor who’s going after the former president on a loony theory about his document retention, whereas the DA can’t even keep his own documents, and it’s in violation of the information laws he is bound by,” Howell added. “He’s a hypocrite. He’s wasting an exorbitant amount of New York’s taxpayer’s dollars to defend this now and delay it and obstruct it when he could’ve just turned it over.”
Bragg’s trial is currently scheduled to start in March 2024 at a critical point in the GOP primaries that could potentially cause problems for Trump if he hasn’t locked up the nomination by then.
