Parents can’t lose custody for refusing to consent to child’s sex change under proposed bill

Republican North Carolina Rep. Virginia Foxx introduced legislation Tuesday which would block child protective services from penalizing parents who refuse to allow their child’s gender transition.

The Parental Right to Protect Act would amend existing child abuse prevention law to state that child protective services cannot remove a child from a guardian’s custody over the guardian’s hesitance or refusal to consent to their gender transition. The legislation comes after several parents lost legal custody of their children because they refused to participate in their gender transitions.

“Parents have the right and responsibility to keep their children safe. This includes making decisions about life-altering medical treatments and interventions,” Foxx said in a press release. “Determining your child is not going to receive gender transition interventions is not abuse or neglect — it is a parent rightfully making a decision for his or her child. No system should remove a child, or investigate a family for abuse, based on this decision. Nor should a hospital or state be able to circumvent a parent’s right to decide whether his or her child should undergo gender-transition interventions.”

One California mother lost custody of her daughter over her refusal to transition her 15-year-old daughter, and an Illinois mother lost a custody battle with her ex-husband for refusing her 12-year-old daughter’s gender transition.

Some Democrats have advocated for parents who do not consent to their child’s gender transition to be charged with child abuse.

Transgender identification has soared in prevalence in recent years, leading some medical experts to conclude that the phenomenon is caused by peer influence. While the vast majority of youth with gender identity issues will naturally outgrow them and come to terms with their biological sex, medical procedures offered to adolescents such as hormones and surgeries are irreversible and carry considerable health risks.
