Investigative journo John Solomon fires back after Twitter suspends him with a warning for readers

Early this week Twitter reportedly suspended investigative journalist John Solomon’s account for 12 hours and began warning Twitter users against accessing an article that’s been posted at his news site, Just The News.

These punishments were imposed on the journalist and his news site after his team committed the crime of conducting real (versus fake) journalism, and he personally committed the crime of sharing this journalism on Twitter.

In an article posted on Christmas Eve, a Just The News contributor correctly noted that the version of some of the Pfizer vaccines that are being distributed to the American people is not legally the same as the one that was “fully approved” by the FDA.

“The Pfizer-BioNTech vaccine allowed under federal Emergency Use Authorization (EUA) in December 2020 and the Comirnaty vaccine approved by the FDA in August are identical. … However, the two vaccines are legally distinct, raising questions over the legality of vaccine mandates,” it noted.

This is all factual information. In fact, Pfizer even issued a statement to Just The News.

“In terms of its ingredients and how it is made, the FDA-approved vaccine is no different from the vaccine that has been administered, to date, to hundreds of millions around the world under the EUA,” a spokesperson for the pharmaceutical giant said.

“The FDA-approved Comirnaty and the EUA-authorized Pfizer-BioNTech COVID-19 vaccine have the same formulation and, according to the FDA labeling, can be used interchangeably to provide the COVID-19 vaccination series,” they added.

Nevertheless, Just The News noted, even the FDA has acknowledged that the two identical vaccines “are legally distinct,” meaning that distributing them requires jumping over “different legal” hurdles.

This is important because the federal government reportedly lacks the authority to issue vaccine mandates for vaccines “that have only been authorized under EUA,” according to Just The News.

This is a fact that could prove paramount to those who are suing the Biden administration over its litany of vaccine mandates.

But, according to Twitter, it’s a fact that is “unsafe”:

“Unsafe” enough that when Solomon tweeted it out to his followers, Twitter suspended him for 12 hours and began peddling this “unsafe” warning anytime a random user also posted the article and someone else clicked on it.

“Twitter suspended the account of Just the News founder John Solomon for sharing an article about the legal distinctions between Pfizer’s fully approved and emergency use authorization (EUA) COVID-19 vaccines, which could affect the legality of vaccine mandates,” according to an update from Just The News.

“The social media company is also warning users who click the link to the article from individual tweets that it ‘may be unsafe’ and ‘could lead to real-world harm.’ An immunologist who reviewed the article told Just the News he saw nothing wrong with it factually,” the update continued.

Solomon is not pleased.

“It is outrageous and unfair that a story that is completely accurate and points out an important legal distinction between the two versions of vaccines gets blocked and my account suspended,” he said in a statement to Just the News.

“The distinction was important enough for a federal judge to note. The story and my post weren’t unsafe. The only threat is to the safety of the 1st Amendment afflicted by Twitter’s wrongheaded decision,” the journalist added.

The judge he referenced is Judge Allen Winsor of the U.S. District Court for the Northern District of Florida. In a ruling last month, he wrote that “FDA licensure does not retroactively apply to vials shipped before BLA approval” and that “the DOD cannot mandate vaccines that only have an EUA.”

The ruling was made in a case involving 16 service members who’d sued the Department of Defense over its vaccine mandate. The case is reportedly still ongoing.

Regarding the Just The News article that’s being censored, the news site found a number of credentialed voices to defend its factual accuracy.

“There is nothing in the story that is not well reported or misleading. Twitter’s censorship of COVID information has contributed greatly to the collapse in trust in public health,” Stanford School of Medicine professor Jay Bhattacharya said.

He would know. He’s a co-author of the Great Barrington Declaration, the anti-lockdown manifesto that was targeted for censorship after members of the federal government, including Dr. Anthony Fauci, demanded the dissent be silenced.

“It is scary to live in such censorship, which also lea[d]s to self censorship,” Harvard Medical School epidemiologist Martin Kulldorff, another co-author of the manifesto, added.

In an emailed statement to Just The News, Indiana University immunologist Steve Templeton said that “the article itself seems ok as far as I understand it,” though he did raise some concerns about the title.

The headline reads as follows: “Pfizer to continue distributing version of COVID-19 vaccine not fully approved by FDA.”

But again, the headline is factually accurate.

“Seems like a legal issue if the two [vaccines] are only different in how they were labeled or when they were packaged,” Templeton reportedly added.
