Kamala on Supreme Court? Who saw this coming? Buzz about ‘nuclear option’ to get rid of Harris

Suffice it to say it’s one way to get rid of her, but who saw this coming?

In what they admit is a “highly improbable” scenario floating around the Washington, D.C., rumor mill, The Telegraph is reporting that Democrats are “considering the nuclear option” to clear the way for a more viable 2024 presidential candidate, given Vice President Kamala Harris’s historically low approval rating numbers. The nuclear option here being to appoint “unelectable” Harris to the Supreme Court.

CNN has also thrown the scenario up against the wall in its report earlier this month on the “entrenched dysfunction and lack of focus” from Team Harris: “Defenders and people who care for Harris are getting frantic… When they’re depressed, they bat down the Aaron Sorkin-style rumor that Biden might try to replace her by nominating her to a Supreme Court vacancy. That chatter has already reached top levels of the Biden orbit, according to one person who’s heard it.”

The given here, of course, is that frail, 79-year-old President Joe Biden, whose cognitive decline is more and more obvious to many with every passing day, will not run for reelection — he’ll be 82-years-old in 2024.

“Democrats desperately scrambling to find a potential successor to Joe Biden in 2024 are whispering about a potential nuclear option that could see Kamala Harris, the current Vice President, nominated to the Supreme Court,” The Telegraph reported. “While the scenario is highly improbable, and perhaps a reflection of a Washington rumor mill in overdrive, the fact it has come up at all shows the depths of the predicament the Biden administration currently finds itself in, amid rising inflation, a stalled domestic agenda, and foreign policy disasters.”

The article doesn’t mention Biden’s cognitive ability, but does reference his tanking poll numbers, along with Harris being at “an unelectable 28 percent.” Without context, the piece noted, “If Mr Biden stepped down before Nov 2024, the new vice president, under Section 1 of the 25th Amendment, would assume the presidency, and be able to run as an incumbent. It is, of course, all wildly hypothetical, but constitutionally feasible.”

While Harris was a former prosecutor, few will mistake her as among America’s brightest legal minds, and there would have to be an opening on the high court for the plan to come to fruition. Justice Stephen Breyer, 82, is the oldest jurist on the bench and while some on the left have pressured him to step aside while Democrats control Congress and the White House, he has shown little desire to do so.

Should Harris be appointed to the court, Biden could then pick a popular vice president who would be a better candidate in 2024. For what it’s worth, a sitting vice president has never moved to the Supreme Court, although former President William Taft was nominated to the court in 1921 and served as Chief Justice for a decade.

Another option being bandied about is having a contested presidential primary with other candidates running against Harris but, as the British paper noted, that could be damaging for the party.
