A lawyer representing Don Lemon strongly responded following an interview conducted by podcaster Megyn Kelly with the man who has accused the CNN host of sexual assault over an incident that took place at a bar in the Hamptons three years ago.
Following Kelly’s chat with Dustin Hice on Monday’s edition of her podcast, during which the alleged victim dished his account of what went down that night at Murf’s Backstreet Tavern in Sag Harbor, NY when he attempted to buy Lemon a drink, attorney Caroline J. Polisi dashed off a letter to the former Fox News superstar in which she blasted the interview as “lopsided and inaccurate” and accusing Kelly of having a vendetta against Lemon.
In the blistering letter, a copy of which was obtained by The Daily Mail, Polisi wrote:
“For years now, you have made public statements – on social media, to the press, and on your show – recklessly accusing Mr. Lemon of being biased, of lying to viewers, and of treating his guests unfairly. Although you advertise your podcast as featuring “honest” conversations without “BS” or “agenda,” your podcast today, in which you interviewed Dustin Hice, reveals that you only pay lip service to journalistic ethics.”
The letter was accompanied by a copy of the court filing regarding Hice’s lawsuit against Lemon with the lawyer writing “Given that you are a journalist, I would have expected, at a minimum, that you would have reviewed the filings on the public docket, such as the attached motion papers, which, citing to supporting evidence, substantially undermines Mr. Hice’s credibility and as well as the outlandish story he fabricated about Mr. Lemon.’
“You did not pose any questions to Mr. Hice about these matters, but instead accepted his narrative wholesale, leaving your listeners with a lopsided and inaccurate understanding of Mr. Hice’s allegations or the strength of the evidence he has against Mr. Lemon,” she added.
Polisi’s scathing response came after Hice fleshed out the encounter with graphic details along with his opinion that Lemon is being protected by the media.
“He has his hand in his pants rubbing himself aggressively, and he shoved his two fingers up underneath my mustache.”

Hice told Kelly that after seeing Lemon in the bar that he approached him and said, “Hey Don, let me buy you a drink” and before he could even respond, I looked at the bartender and I said let me get two lemon drops and, if anything, that was an attempt at humor, I didn’t mean anything derogatory or you know, I wasn’t trying to harass him or you know, and Don looks at me and says ‘I’m just trying to have a good time’ and at that time I said, ‘Ok, I’m sorry’ and I walked away and I thought that was the end of it.”
After some questions by Kelly including whether Lemon may have been intoxicated, Hice said, “I mean it seemed like he had had a few drinks, that’s for sure” and that “he did not look sober by any means.”
Kelly then put Hice on the record that he is straight – Lemon is openly gay – and that the drink offer wasn’t a “sexual come-on” and asked him what happened next.
“So I walk around the bar and 5 minutes goes by and he walks, he comes around the bar and comes up to me and he says pardon my language but he says, “do you like me, is that why you’re f***ing with me?” Hice explained, allegedly telling Lemon that wasn’t the case.
He continued, stating that Lemon had his hand “in his pants, was rubbing himself aggressively and he shoves his two fingers up underneath my mustache, thrusts my head back and says “do you like p*ssy or d*ck?” and that he said it “two or three times after that.”
Kelly then asked him if the alleged action could have been something that Lemon had done before, “Anybody that acts like that in public without any fear of what it might do to somebody or the consequences it might have, that’s a pattern,”
Hice answered, “I wouldn’t be surprised,” adding, “He’s protected by the fact that he’s African American, gay man on television and I’m just some nobody.”
In the letter to Kelly, Polisi stated that there are no actual witnesses to the incident and that a trial will prove that Hice “opportunistically fabricated” the sexual assault in order to blackmail Lemon.
She also called for Kelly to issue a correction, “I hope you will correct your reckless reporting today, and the prior public statements you have made about this case — statements that demonstrated a reckless disregard for the truth and absolutely no effort on your part to try to ascertain the facts.”
