New York City Mayor Bill de Blasio gave public school teachers and staff who have not yet gotten a COVID-19 vaccine until Friday to get one or they will be replaced.
DeBlasio issued his ultimatum on Monday after an appeals court ruled late in the day that his mandate could move forward.
The mayor told Spectrum News 1 that all public school employees must get at least one dose of the vaccine by 5 p.m. Oct. 1, or they risk losing their jobs.
“If you have not have gotten that first dose by Friday, 5 p.m., we will assume you are not coming to work on Monday and you will not be paid starting Monday and we will fill your role with a substitute or an alternative employee,” said the mayor.
De Blasio issued his threat following a ruling by a three-judge panel of the Second U.S. Circuit Court of Appeals, which found that the city’s vaccine mandate is valid and can proceed; the court was previously scheduled to hold a hearing on the matter on Wednesday.

The panel’s ruling surprised attorney Louis Gelormino, who is representing unvaccinated NYC public school staff, including thousands of teachers.
In an interview Monday with Fox News’ Tucker Carlson following the ruling, the lawyer said the decision was unexpected and “unprecedented” after a court issued a temporary injunction blocking the vaccine mandate last week.

“The city came in and asked for an expedited review of [the temporary restraining order] and the court granted it…unbeknownst to us,” Gelorimino, who has filed a lawsuit to stop the mandate, said, adding that the court summarily canceled the Wednesday hearing. That means, “in effect, Mayor de Blasio’s vaccine mandate is now in effect and might cost over 28,000 teachers and Department of Education[s] their jobs by Friday.”
In response, Carlson asked the attorney if he was aware of “any evidence of any kind that unvaccinated teachers have posed a risk to anybody, ever.”
“Absolutely not,” the attorney said. “The unvaccinated teachers, they’re not conspiracy theorists. They don’t think the government is out to get them. There’s a lot of different reasons why unvaccinated teachers don’t wanna take the vaccine.
“If I told you the amount of pregnant women crying on the phone to me in the last week, the amount of women nursing, the amount of single mothers that are going to lose their job because they don’t wanna take the vaccine — it would be shocking, I’m telling you Tucker, I’m not exaggerating. The numbers are in the thousands that have called me in the last two weeks.”
De Blasio went on to say that the vaccine requirement will officially take effect Oct. 4 after public school teachers and staff were originally supposed to be at least partially vaccinated by Monday.
“Vaccinations are our strongest tool in the fight against COVID-19 – this ruling is on the right side of the law and will protect our students and staff,” said the NYC Department of Education in a statement.
De Blasio told Spectrum News 1 that about 87 percent of Department of Education employees have gotten at least a single dose of the COVID jab thus far; that figure includes around nine out of 10 teachers and 97 percent of principals.
