MSNBC legal analyst calls on Merrick Garland to have Trump arrested over hypothetical ‘Insurrection 2.0’

An attorney who works as a legal analyst for NBC News and MSNBC said this week that the Biden administration should arrest and charge former President Donald Trump for the supposed pre-crime of fomenting a second “insurrection.”

Attorney Glenn Kirschner, known for his extreme takes, made the bold assertion while speaking with radically far-left SiriusXM host Dean Obeidallah.

“Isn’t there now a public safety issue — don’t we have to move out and charge Trump because he’s out there continuing to push ‘the big lie,’ continuing to grift his base and [is] in a very real sense recruiting the foot soldiers for insurrection 2.0?” he said.

The former president has been doubling down on his claims of 2020 election fraud, and according to Kirschner, this apparently is now a criminal offense.

“I think nothing would make Donald Trump happier than insurrection 2.0,” he added.

Like other members of the far-left, Kirschner falsely calls the Jan. 6th riot at the U.S. Capitol an “insurrection” and blames Trump for said “insurrection.” Also, he believes another so-called “insurrection” is just around the corner.

For the record, Trump was acquitted by the U.S. Senate in February on the charge of “incitement of insurrection.”

Kirschner continued by speaking about his past experience as a federal attorney in the D.C. area and relating it to his desire to see Trump arrested.

“Every time I was involved in a covert investigation in the grand jury — for example, going after a gang in D.C. — every single day we had to make the assessment, do we continue to investigate covertly and let these guys run around on the streets of Washington, D.C., potentially hurting others,” he said.

“Or have the scales tipped and is now public safety such a concern that we have to take down the investigation and make arrests and go public? I maintain that even though Merrick Garland needs time to investigate and we’re still sort of in the early stages of a criminal investigation, public safety is at risk,” he added.

For the record, Attorney General Merrick Garland doesn’t appear to be investigating the former president for anything. The Department of Justice has been investigating and pursuing charges against some of the rioters themselves, but that appears to be it.

If anything, Garland has faced backlash from the far-left for refusing to arbitrarily go after the former president and top his officials.

According to The Washington Post, what they want is for him to behave the exact same way they’d falsely accused Trump-era Attorney General Bill Barr of behaving.

“What the critics are suggesting, in essence, is that Trump’s flouting of norms was so extreme and pervasive that to reset the balance, Garland should judiciously use his discretion to depart from standard practice,” the Post noted in a recent piece.

In other words, in response to Trump’s alleged lawlessness, the Biden administration should be equally lawless. Kirschner appears to subscribe to this line of thinking.

Concluding his remarks on Obeidallah’s show, he then outlined the exact strategy he’d use to arrest former President Trump.

“You could take volume two of the Mueller report, which documents all of Donald Trump’s criminal obstruction of justice, and you could staple it to an affidavit in support of an arrest warrant, hand it to a judge and that judge 10 times out of 10 would sign an arrest warrant for Donald Trump,” he said.

“That’s the part that really irks me to no end, because there are crimes for which Donald Trump can and should be arrested and indicted right now, but instead we are leaving him out there to grift his base, to continue to push ‘the big lie’ and to recruit foot soldiers for insurrection 2.0. That’s what has to be addressed now,” he added.

Speaking of grifters, Kirschner appears to be a big fan of the Lincoln Project.

The supposed piece of evidence that Kirschner believes would justify Trump’s immediate arrest — former special counsel Robert Mueller’s report — was, in fact, a complete bust that doesn’t seem like it’d justify anything.

As noted in the tweet below by Pulitzer Prize-winning journalist Glenn Greenwald, the report finally put an end to the Russian collusion delusion conspiracy theory.
