The now-effectively acquitted Louisville, Kentucky police officer who fatally shot Breonna Taylor during a raid in March announced Friday through his attorney that he intends to sue everybody who’s smeared him as a “murderer.”
In an emailed statement to The Courier-Journal, attorney Todd McMurtry said he’s representing Louisville Metro Police Sgt. Jonathan Mattingly “with regard to affirmative claims he has against people who called him a ‘murderer.’ These statements are defamatory and actionable.”
A grand jury convened by Kentucky Attorney General Daniel Cameron declined on Thursday to indict Mattingly for shooting Taylor.
Speaking after the decision was announced, Cameron made it clear that Mattingly and his partner, Detective Myles Cosgrove, had opened fire in self-defense.
“Detective Cosgrove and Sergeant Mattingly were justified in returning fire because they were fired upon. … We have vigorous self-defense laws in this state. And that is something that existed prior to this case,” he said.
Only one officer involved in the shooting, former Detective Brett Hankison, was indicted, albeit for charges not directly linked to Taylor’s death.
Following the grand jury’s ruling Thursday, McMurtry issued the following warning via his Twitter account:
No indictments against John Mattingly and Myles Cosgrove in the #BreonnaTaylor matter. Anyone who called these honorable men “murderers” needs to retract and apologize immediately.

During the March 13th raid, Mattingly, Cosgrove and Hankison tried executing a search warrant by first knocking on the door multiple times. After receiving no response, they forced the door open and stepped inside, only to be fired upon by Taylor’s boyfriend, Kenneth Walker. Mattingly sustained a wound to the femoral artery and immediately began returning fire, unintentionally fatally striking Taylor in the process.
Taylor’s death led to an outpouring of rage and accusations, with Black Lives Matter extremists proclaiming her death an unjust murder.
A video posted to Twitter by McMurty shows Mattingly being taken care of as best as possible after he was shot — and nearly killed — by Taylor’s boyfriend:

“They called him a ‘murderer,’ when all he did was defend himself,” the officer’s attorney wrote as a caption to the video.
Whether or not Mattingly will win his cases — none of which have been filed yet — remains unclear, though the smearing of former Covington Catholic High School student Nick Sandmann does seem to bode well for him.
After an altercation in 2018 between Sandmann and a far-left wing activist who also happens to be Native American, the media pounced on the then-16-year-kid and his peers, deriding them as racists, bigots, you name it.
It was later learned that the altercation had been started by the Native American man, Nathan Phillips, whom it was further revealed had a history of antagonizing people.
The media’s dishonest reporting spurred Sandmann into hiring multiple attorneys and filing suit. As of late 2020, he’d already effectively won two of those suits — one against CNN, and another against The Washington Post.
Here’s the kicker: One of the attorneys who’s been representing Sandmann is none other than Todd McMurtry, who describes himself on Twitter as a ” lawyer committed to fighting for the underdogs who are doxxed, defamed and harassed by the Left.”
Correction: “SUCCESSFUL* lawyer …”
While it’s not clear whom exactly Mattingly might target with his pending suits, the number of possible plaintiffs keeps increasing.
