Ted Cruz warns RBG successor MUST be confirmed before election day. Here’s why.

Though congressional Democrats have loudly come out against President Donald Trump nominating a successor to the late Supreme Court Justice Ruth Bader Ginsburg, it’s because of their own actions that a successor must be chosen and confirmed immediately lest a constitutional crisis erupt, according to Sen. Ted Cruz.

Speaking late Friday evening on Fox News’ “Hannity,” the Texas senator explained that, because of all the election games Democrats are playing, the election may very well wind up being decided by the high court, meaning it’s fundamental that there be enough judges on the court for a definitive decision to be reached.

“[O]ne reason in particular why I think it is tremendously important that not only does the nomination happen next week but that the confirmation happens before election day is because Democrats and Joe Biden have made clear they intend to challenge this election, they intend to fight the legitimacy of the election as you know,” he said.

He added, “Hillary Clinton has told Joe Biden under no circumstances should you concede, you should challenge this election.”

This is true.

Plus, Cruz noted, the court currently contains an equal number of conservatives and liberals, thus increasing the chances of a catastrophic stalemate.

“We cannot have election day come and go with a 4-4 court. A 4-4 court that is equally divided cannot decide anything, and I think we risk a constitutional crisis if we do not have a nine-justice Supreme Court, particularly when there is such a risk of a contested litigation and a contested election,” the senator continued.

The last contested election occurred after the 2000 presidential election, when the Supreme Court was forced to choose between then-GOP nominee George W. Bush and then-Democrat nominee Al Gore. At the time, the court contained nine justices, which therefore allowed the court to reach a relatively quick and painless decision.

“Twenty years ago I was part of the legal team that litigated Bush vs. Gore and went to the Supreme Court. Thirty-seven days the country did not know who the president was going to be, and if we had a 4-4 court, it could have dragged on for weeks and months. And so I think we have a responsibility to do our job,” Cruz continued.

“The president should nominate a principled constitutionalist with a proven record, and the Senate is going to take a lot of work to get it done before election day, but I think we should do our job and protect the country from the constitutional crisis that could result otherwise.”

Complications could arise because Democrats have been doing everything in their power to complicate the election process, including promoting universal mail-in ballots, which the evidence has consistently shown are not entirely reliable:

In Pennsylvania, Secretary of State Kathy Boockvar, a Democrat, issued guidance this week saying in effect that mail-in ballots cannot be rejected if the signatures on them don’t match the signatures on file.

This means someone could steal a voter’s mail-in ballot from the voter’s mailbox, fill it out as desired, place a fake signature on it and then submit it without any questions being asked.

This comes as numerous stories have emerged of mail-in ballots being used to perpetrate fraud.

Earlier this month the Public Interest Legal Foundation filed a pair of court briefs asserting that it’d discovered that thousands of Georgia and North Carolina residents had used mail-in ballots to vote twice during the 2016 and 2018 elections.

Earlier still this month 19 illegal aliens living in North Carolina were charged with voter fraud.

Last month was even more hectic.

In August a report emerged that at least 25 percent of the mail-in ballots filed in Brooklyn during New York City’s June 23rd primary election were declared invalid because of disqualifiers ranging from a lack of postmark to missing signatures and even delayed delivery.

Another report emerged that more than 100,000 mail-in ballots from California’s March 3rd primary elections were tossed over similar concerns.

And yet another report emerged that Michigan had had to reject 846 mail-in ballots that were filed during the state’s Aug 4th primary elections because the voters were dead.

Similar reports also emerged in July and May:

The most startling report came from the New York Post, which interviewed an anonymous top Democrat Party operative who outlined the many shady tactics Democrats have used over the years to cheat in elections.

“There is no race in New Jersey — from City Council to the United States Senate — that we haven’t worked on. I worked on a fire commissioner’s race in Burlington County. The smaller the race the easier it is to do,” he said.
