The Trump administration faces a lawsuit over its decision to bar families containing illegal aliens from receiving coronavirus stimulus money.
Filed by an Illinois man who goes by the pseudonym John Doe, the suit claims the payments carved out for married couples by the CARES Act discriminates against U.S. citizens who’ve taken the unusual act of choosing illegal aliens as their spouses.
The suit specifically targets three people.
“The suit names Trump, Senate Majority Leader Mitch McConnell and Acting Secretary of the Treasury Steven Mnuchin,” Bloomberg reported Saturday.
“The three authorized the exclusion and in doing so have failed to treat John Doe ‘as equal to his fellow United States citizens,’ according to the lawsuit.”
John Doe claims in the suit that since his illegal alien wife pays taxes through an Individual Taxpayer Identification Number (ITIN), they should be eligible for a CARES Act payment.
As it stands, the CARES Act signed into law by President Donald Trump late last month allows married couples to receive a stimulus check of up to $2,400, in addition to $500 per child under the age of 17.
However, the bill stipulates that the couple’s combined income must not surpass $150,000, and that both spouses must possess a Social Security Number.
This fact hasn’t sat well with members of the far-left:

“My belief is if you’re paying taxes you should be eligible for the stipend,” Mayor Kenney says of Trump’s policy that prohibits taxpayers married to undocumented citizens from receiving stimulus money.
Kenney adds Trump’s base is “ever-dwindling.”

The latter tweet is false. The CARES Act doesn’t target immigrants. It targets those “immigrants” who lack a Social Security Number.
“Only U.S. citizens and immigrants with Social Security Numbers (SSN) are eligible for stimulus checks from the federal government’s COVID-19 economic relief package,” Snopes notes.
“The legislation’s guidelines exclude the remainder of the country’s immigrant population from receiving the one-time payments — and, in effect, their spouses won’t get the money either if the couple filed a joint tax return (and are not in the military).”
However, while it’s possible for some classes of legal immigrants to be stuck with an ITIN versus SSN, it’s clear that John Doe pertains specifically to an illegal alien.
In making his legal argument for why the Trump administration should be forced to fork over cash to him his and his wife, John Doe cited the Migration Policy Institute’s stats on how illegal aliens living in the U.S. are married to U.S. Citizens.
The suit comes amid an effort by Democrat officials across the country to funnel taxpayer funds into the hands of illegal aliens.

California Gov. Gavin Newsom reportedly created a $125 million fund for illegals.
Chicago Mayor Lori Lightfoot transferred money from the city’s Small Business Resiliency Program over for illegal aliens.
Minneapolis Mayor Jacob Frey announced plans to create a $5 million fund for all locals, including illegals.
And New Jersey Gov. Phil Murphy told the media this Wednesday that he too is looking at creating a fund for illegals.
Meanwhile, some of the same Democrat lawmakers who support the use of draconian methods to force law-abiding Americans to remain at home are rushing to cater to the interests of illegal aliens.
These moves haven’t sat well with congressional Republicans.
“While Americans are forced to stay at home and out of work, Democrats want to release detained illegal aliens, the majority of whom have criminal records, and also provide them with stimulus checks,” said @CongressmanHice.

“This concept ought to be simple: We should not turn our back on the citizens and lawful immigrants of this great country to favor those that broke the law and came here illegally or overstayed their visas,” House Oversight Committee Ranking Member Jim Jordan said this week. “And that is especially true when this country is in the middle of a dire public health crisis.”
The remarks were made during a briefing with ICE and CBP officials. Jordan also slammed congressional Democrats for responding to the coronavirus pandemic by pushing for the elimination of ICE and the shuttering of detention facilities.
