James Comey’s ‘next reckoning’ reportedly looming as scrutiny over leaked memos ramps up

James Comey, along with others being probed in the investigations by Inspector General Michael Horowitz and Special Prosecutor John Durham, “remain under scrutiny” due to “significant issues emerging with how the FISA was handled and other conduct in the investigation,” according to a source reported by John Solomon.

As Durham’s investigation continues, the pending IG report is expected to reach the conclusion that Comey improperly and illegally took home with him memos that were classified up to the “Secret” level and were FBI property after he was fired as director of the agency. He then reportedly transmitted classified information via an insecure email account.

Solomon reported in his Wednesday column published by The Hill:

The memos, which mostly recount Comey’s interactions with Trump in the Russia case and include information about foreign leaders, were sensitive enough to require government officials to send a professional “scrub team” to a Comey lawyer’s office to ensure all classified information was deleted, sources previously told me.

FBI agents, when they went to Comey’s residence, found a secret, unreported memo according to bureau documentation obtained from a Freedom of Information Act request by Judicial Watch. At the time, Comey also admitted that two other memos “were missing.”

In April, a court-ordered filing by the Department of Justice found that Comey included a great deal of sensitive and classified information in a range of comprehensive personal memos — to include the details of his conversations with Trump, as well as the “code name and true identity” of a confidential source.

According to a Fox News article, “Comey meticulously outlined ‘foreign intelligence information obtained from and through’ the key human source, ‘information about whether the FBI initiated coverage through the Foreign Intelligence Surveillance Act (FISA) on a particular individual,’ relevant ‘sources and methods’ used in the FBI’s investigation and ‘information concerning the President’s foreign policy decisionmaking,’ according to the DOJ.”

Solomon’s report indicates that, although Horowitz’s team referred James Comey for possible prosecution for leaking contents of his classified memos, Attorney General Bill Barr’s DOJ prosecutors have decided to decline prosecution due to lack of “enough evidence of Comey’s intent to violate the law.”

As Solomon noted when tweeting his report, prosecution is unlikely but Comey will likely not escape his ‘next reckoning.’

In Comey’s congressional testimony, he admitted that he shared information with a friend that was classified at the lowest level of “confidential.” It was found “that classification was made by the FBI after Comey had transmitted the information.” One of Solomon’s sources told him that the DOJ decided not to “make its first case against the Russia investigators with such thin margins and look petty and vindictive.”

Nonetheless, Comey and others within the FBI and DOJ during his Obama-era tenure are still facing legal trouble in the ongoing probes by the IG and John Durham, which are now focused on the origins of the Russia investigation that included a Foreign Intelligence Surveillance Act (FISA) warrant targeting the Trump campaign at the end of the 2016 election, the source told Solomon.

“There are significant issues emerging with how the FISA was handled and other conduct in the investigation, and everyone involved remains under scrutiny,” a second source said.
