Judge orders Antifa activist, schoolteacher to pay Judicial Watch $22,000 in legal fees

Infamous Antifa activist and middle school teacher Yvette Felarca has been ordered by California District Judge Vince Chhabria to pay $22,000 in legal fees incurred by Judicial Watch as well as $4,000 in litigation costs. The judge acted in a case in which he described the radical leftist Felarca’s legal claims as “entirely frivolous.”

Felarca is still a middle school teacher in Berkeley, California, even after multiple arrests for violence. According to CNS News, she had sued her school district to try to prevent it from turning over to Judicial Watch the district’s communications mentioning Felarca, Antifa, and BAMN, By Any Means Necessary–another radical group to which the teacher is said to be a prominent member.

BAMN (By Any Means Necessary) is a group that was founded by the Marxist Revolutionary Workers League whose mission is to protest conservative speaking engagements.

“This is a huge victory for Judicial Watch (JW) against Antifa and the violent left,” said Judicial Watch President Tom Fitton. “Ms. Felarca attacked Judicial Watch without basis and the court was right to reject her ploy to deny our ‘right to know’ because we don’t share her violent left views.”

According to a JW statement, “In 2017, Judicial Watch filed a California Public Records Act (CPRA) request seeking public records information about Felarca’s Antifa activism and its effect within the Berkeley Unified School District. In her lawsuit aimed at keeping the Berkeley school district from furnishing the records, Felarca alleged that Judicial Watch was misusing the law for political means and the district should refuse to provide the information.”

“Judicial Watch is entitled to attorney’s fees because the plaintiffs’ lawsuit was frivolous, and their litigation conduct was unreasonable,” the judge said in his ruling. The plaintiffs “had no reasonable argument to protect those documents from disclosure.”

The plaintiffs “had no reasonable argument to protect those documents from disclosure,” stated Judge Chhabria. He said that Felarca and her co-plaintiffs’ First Amendment claims were “premised on the obviously baseless assumption” that the First Amendment condemns the speech of some while condoning the ideological missions of others.

In addition, the judge stated, “The plaintiffs also mischaracterized the documents under review” and that the plaintiffs “failed to grapple with the role Ms. Felarca played in making herself a topic of public discourse through her physical conduct at public rallies and her voluntary appearance on Fox News.”

Felarca has a long history of radical left activism and has been ordered in previous court cases to pay fines and attorney fees. It is unknown whether she actually has paid those past fees.

In January of 2018, a court in California ordered her to pay $11,000 after she filed a frivolous restraining order against the former Berkeley College Republicans president. The press release announcing that judgment noted Felarca was arrested twice in 2017 for incitement of a riot, resisting arrest, and assaulting a police officer.

In January of this year, she was ordered to stand trial in Sacramento, Calif., because of an alleged assault that occurred at a demonstration in 2016.

Amazingly, this woman has kept her public school job and she is actually teaching young people.
