A Democrat running for Congress in Georgia plans on continuing his bid for the seat as he sits in a jail cell after being convicted for driving under the influence.

Steven Foster, who was sentenced to six months in on Aug. 6 for the DUI, has refused to drop out of the race despite calls from Democratic party officials and his own hometown newspaper telling him to drop out of the race, according to Politically Georgia.

Foster is scheduled to see a judge in Whitfield County on Tuesday and is reportedly expecting to try to get out on bond and continue his campaign against Republican Rep. Tom Graves.

“He’s fighting for what he believes, and that is what makes a good congressman,” Connie Hall-Scott, Foster’s fiancé and campaign spokeswoman told the news outlet. “His beliefs, his passion has not changed because he’s sitting in jail over a misdemeanor,” she continued.

This is not Foster’s first run in with law enforcement —  he was investigated by the U.S. Army for allegedly stealing surplus military boats to deliver humanitarian aid to Hurricane Mitch victims in the 1990s.

Foster has also taken heat for getting his medical license taken away in the state of Georgia in 2002. He reportedly failed to take a mental and physical examination.

The Democratic candidate could have been taken off the ballot if the state party would have made the decision by Friday. Since they did not Foster will continue to run and his name will still appear on the ballot.

Foster’s website was down at time of publication.
