Lois Lerner is the Teflon former IRS executive.
Nothing sticks.
Even a Republican Justice Department, apparently, couldn’t find the wherewithal to find any legal issue with the fact that Lerner is alleged to have intentionally targeted conservative groups during both the 2010 and 2012 elections.
Assistant Attorney General Kevin Boyd reportedly reviewed the case and decided that the “available evidence” does not exist to reopen the investigation.
“After this process, the Department determined that reopening the investigation would not be appropriate based on the available evidence,” Boyd wrote in a letter to GOP Congressmen Kevin Brady, chairman of the House Ways and Means Committee, and Peter Roskam, chairman of the subcommittee on tax policy, who both in April had asked Attorney General Sessions to review the case.

Lerner, who is currently retired from the IRS, pleaded the Fifth during two different congressional hearings in 2013 and 2014 when she was accused of “improperly targeting tea party affiliated groups by denying or stonewalling their applications for tax-exempt status,” according to the Daily Caller.
When the House Ways and Means Committee referred Lerner for prosecution in 2014, President Obama’s Justice Department declined.
While that was almost expected, one might think a Justice Department under Jeff Sessions might think differently.
But in this case at least, both parties are simply two sides of the same coin.

Brady was sharply critical of the decision, saying in a statement: “This is a terrible decision. It sends the message that the same legal, ethical, and Constitutional standards we all live by do not apply to Washington political appointees — who will now have the green light to target Americans for their political beliefs and mislead investigators without ever being held accountable for their lawlessness.”
Brady still has “the utmost respect” for the attorney general, but he’s “troubled by his Department’s lack of action to fully respond to our request and deliver accountability.”
“Today’s decision does not mean Lois Lerner is innocent. It means the justice system in Washington is deeply flawed,” said Brady.
Roskam went even farther, calling the decision “a miscarriage of justice.”
