A Maryland boy who ate his ‘Pop-Tart’ into a gun while at school received more bad news this week when his fight against his suspension went south.

Josh Welch, a seven year-old, suddenly found himself in national headlines in March 2013 when he ate his lunch Pop-Tart into the shape of a gun and pretended to fire it. Welch was subsequently suspended for it.

After fighting his suspension for three years, the boy’s father, BJ Welch received the ruling by the local circuit court judge who announced he would be upholding his son’s suspension for eating his lunch into a gun-shape, according to WJZ News.

“No violence, no real weapon, no ammunition,” Robin Ficker, the family’s attorney said.

“It will be on his record in school and every time he goes into a new grade. There’s a presumption he did something wrong and he’s a bad kid,” he said.

WJZ reported:

Officials with Anne Arundel County Schools have always said Josh’s behavior wasn’t a one-time deal. They say there were 20 documented incidents before he was even suspended.

They released a statement, saying in part: “We have believed from the outset that the actions of the school staff were not only appropriate and consistent, but in the best interests of all students.”

Ficker says his next move is to appeal, and even though the school continues to hold its ground, he will keep firing away.
