President Obama’s recommendation last week that all public schools allow transgender students to use the bathroom of their choosing is causing at least one group of State lawmakers to recommend the ultimate presidential sanction.
On Thursday, several Republican Oklahoma lawmakers introduced a resolution that would ask the state’s congressional delegation to file articles of impeachment against President Obama, Attorney General Loretta Lynch, Secretary of Education John King and several other administration officials over the White House directive.
Republican state representative John Bennett called the White House’s transgender policy “biblically wrong,” and also, more pertinent to the call for impeachment, a violation of state sovereignty.
The 10th Amendment to the Constitution specifically reserves for the states and the people the powers not expressly granted to the federal government by the Constitution. Reuters reported that impeachment advocates think the President has clearly, “overstepped his constitutional authority.” Although stranger things have been “interpreted” these days, one would certainly be hard-pressed to find transgender bathroom policies anywhere in the Constitution.
The recommendation, even if passed, would be “non-binding,” but the fact that the word “impeachment” has even entered the conversation speaks to the divisiveness of the issue.
Supporters of the transgender guidelines consider the resolution nothing more than fear mongering. In a statement to Reuters, Troy Stevenson, executive director of Freedom Oklahoma (a LGBT advocacy group), wrote, “In a time when our state is facing an unprecedented economic crisis, our lawmakers should be focused on righting the ship rather than stigmatizing transgender youth.”
No vote has been scheduled on the bill, and even if it passes the legislature the prospects are likely grim considering the Oklahoma governor, Mary Fallin, just vetoed a bill that would have outlawed certain abortion procedures.
